SENATE BILL NO. 115

CHILDREN.  Provides relative to child support enforcement. (8/1/18)
1	AN ACT
2 To amend and reenact R.S. 46:236.9(K) and to enact R.S. 46:236.9(L), relative to child
3 support enforcement; to provide for cooperation between the Department of Revenue
4 and the Department of Children and Family Services; to provide for the sharing of
5 data; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 46:236.9(K) is hereby amended and reenacted and R.S. 46:236.9(L)
8 is hereby enacted to read as follows:
9 ยง236.9. Collection of child support; data sharing; cooperative program

11	K. Pursuant to the cooperative program established by this Section, the
12 department shall report to the Department of Children and Family Services the
13 name of any employer of an obligated parent who obtains or makes a change in
14 employment and is paying income taxes when that obligated parent has been
15 identified as delinquent.
16	L. The Department of Revenue and the Department of Children and Family
17 Services are hereby authorized to promulgate rules and regulations as may be

1 necessary to effectuate the provisions of this Section, and to enter into interagency
2 agreements as necessary.

Present law provides for a cooperative program between LDR and DCFS that allows DCFS
to provide the names of obligated parents who are delinquent in child support payments to
LDR for collection. Proposed law provides for LDR to notify DCFS if a delinquent obligated
parent obtains or changes employment and is paying income taxes.
