(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 27:402(17) and (18) and 405(C)(2), (3), and (4), relative to the 3 Video Draw Poker Devices Control Law; to provide for the method of operation of 4 video draw poker devices; to provide for definitions; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 27:402(17) and (18) and 405(C)(2), (3), and (4) are hereby amended 8 and reenacted to read as follows: 9 §402. Definitions 10 As used in this Chapter, the following words and phrases shall have the 11 following meanings unless the context clearly indicates otherwise: 12 * * * 13 (17) "Video draw poker device" means any unit, mechanism, or device 14 authorized pursuant to the provisions of this Chapter, that, upon insertion of a ticket 15 voucher or cash, is available to play or simulate the play of the game of draw poker, 16 or other card games approved by the division utilizing a video display and 17 microprocessors in which the player may win games or credits that can be redeemed Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. The term does not include a device that directly dispenses coins, cash, 2 tokens, or any thing else of value, except the ticket voucher required in accordance 3 with the provisions of this Chapter. The term does not include any device authorized 4 to be used in the conducting of charitable gaming. The term does not include video 5 line up games, mechanical reel games, or any combination thereof, or any slot 6 machine as defined in R.S. 27:353. 7 (18) "Video draw poker" means any card game approved by the division that 8 utilizes one deck of cards per hand with multiple hands permitted per game. 9 * * * 10 §405. Description and specifications of devices 11 * * * 12 C. Each video draw poker device shall offer the game of draw poker or such 13 other card games as are approved by the division and have the following method of 14 operation: 15 * * * 16 (2) The card games must utilize a deck decks of cards consisting of fifty-two 17 standard playing cards, and up to two jokers may also be used. The deck decks must 18 be shuffled by use of a random number generator to exchange each card in the deck 19 decks with another randomly selected card. 20 (3) After shuffling, a required number of cards must be dealt from the top of 21 the deck decks. 22 (4) Any discarded cards must be replaced by remaining cards in the deck 23 decks, starting with the next subsequent card and using the cards in the order of the 24 deck decks. 25 * * * Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. DIGEST SB 116 Original 2018 Regular Session Martiny Present law excludes video line up games, mechanical reel games, or any combination thereof from the definition of "video draw poker device". Proposed law deletes the exclusion of video line up games, mechanical reel games, or any combination thereof from the definition of "video draw poker device". Present law defines "video draw poker" as any card game approved by the division that utilizes one deck of cards per hand with multiple hands permitted per game. Proposed law defines "video draw poker" as any card game approved by the division. Present law provides for the method of operation of each video draw poker device offering the game of draw poker. Provides that it shall utilize a single deck of cards and allows up to two jokers. Proposed law provides for the use of more than one deck of cards in the operation of video poker devices and otherwise retains present law. Effective August 1, 2018.
