2018 Regular Session ENROLLED SENATE BILL NO. 16 BY SENATOR MIZELL AND REPRESENTATIVES AMEDEE, ANDERS, ARMES, BACALA, BAGNERIS, BARRAS, BERTHELOT, BILLIOT, TERRY BROWN, CARMODY, CARPENTER, CHANEY, DAVIS, EDMONDS, FALCONER, FOIL, GISCLAIR, HAVARD, HAZEL, HENRY, HILL, HORTON, HOWARD, JOHNSON, PIERRE, REYNOLDS, SCHEXNAYDER, STOKES, TAL BOT, WHITE AND WRIGHT 1 AN ACT 2 To amend and reenact R.S. 47:463(A)(3)(a) and to enact R.S. 47:463.4.4 and 463.196, 3 relative to special prestige license plates; to provide for a special prestige license 4 plate to bear the international symbol of accessibility; to provide for the "Upside 5 Downs" special prestige license plate; to provide an effective date; and to provide for 6 related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 47:463(A)(3)(a) is hereby amended and reenacted and R.S. 9 47:463.4.4 and 463.196 are hereby enacted to read as follows: 10 §463. Private passenger vehicles; amputee veterans exempted; church, church 11 school, and religious order vehicles 12 A. 13 * * * 14 (3)(a) The deputy secretary of the Department of Public Safety and 15 Corrections, public safety services, shall issue license plates for private passenger 16 vehicles. After July 1, 1992, there shall be issued one uniform identifiable Louisiana 17 license plate, the style of which shall be proposed by the department and approved 18 by the legislature on or before July 1, 1992. However, all special prestige license 19 plates issued in accordance with R.S. 47:463.6 et seq. shall contain the uniform 20 alpha-numeric series accompanied by a symbol or emblem representing the 21 organization requesting such plate, and, on and after January 1, 2019, the 22 international symbol of accessibility, upon request, if the applicant is eligible in 23 accordance with the provisions of R.S. 47:463.4. SB NO. 16 ENROLLED 1 after August 15, 1999, shall include a handling charge of three dollars and fifty cents 2 to offset the administrative costs of the department for the issuance of such plates. 3 * * * 4 §463.4.4. Special prestige license plates; international symbol of accessibility 5 A. Upon request and if the applicant is eligible in accordance with the 6 provisions of R. S. 47:463.4, any available special prestige license plate issued 7 by the deputy secretary of the Department of Public Safety and Corrections, 8 public safety services, may additionally bear the international symbol of 9 accessibility. 10 B. The deputy secretary shall provide by rules and regulations for the 11 implementation of this Section. Such rules and regulations shall be subject to 12 oversight review conducted by the house and senate committees on 13 transportation, highways and public works. 14 * * * 15 §463.196. Special prestige license plate; "Upside Downs" 16 A. The secretary of the Department of Public Safety and Corrections 17 shall establish a special prestige motor vehicle license plate to be known as the 18 "Upside Downs" plate, provided there is a minimum of one thousand applicants 19 for such plate. The plate shall be restricted to use on passenger cars, pickup 20 trucks, recreational vehicles, motorcycles, and vans. 21 B. The secretary shall work in conjunction with the director of Upside 22 Downs, Beau Brooks, to select the color and design of the plate, provided it is 23 in compliance with R.S. 47:463(A)(3). 24 C. The special prestige license plate shall be issued, upon application, to 25 any citizen of Louisiana in the same manner as any other motor vehicle license 26 plate. 27 D. The department shall collect an annual royalty fee of twenty-five 28 dollars that shall be disbursed in accordance with Subsection E of this Section. 29 This fee shall be in addition to the standard motor vehicle license tax imposed 30 by Article VII, Section 5 of the Constitution of Louisiana, and a handling fee of Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 16 ENROLLED 1 three dollars and fifty cents for each plate to be retained by the department to 2 offset a portion of administrative costs. 3 E. The annual royalty fee shall be collected by the department and 4 forwarded to Upside Downs, Inc. 5 F. The secretary shall promulgate and adopt rules and regulations as are 6 necessary to implement the provisions of this Section. 7 Section 2. This Act shall become effective on January 1, 2019; if vetoed by the 8 governor and subsequently approved by the legislature, this Act shall become effective on 9 January 1, 2019, or on the day following such approval by the legislature, whichever is later.
