SENATE BILL NO. 163

1	A JOINT RESOLUTION
2 Proposing to add Article VII, Sections 18(G)(6), 21(K)(4) and (M)(4) of the Constitution of
3 Louisiana, relative to ad valorem taxes; to provide with respect to eligibility for the
4 special assessment level and certain exemptions; to authorize the special assessment
5 level for homesteads, the additional exemption for disabled veterans and their
6 spouses, and the exemption for surviving spouses of military personnel, law
7 enforcement and fire protection officers, and first responders to apply to trusts under
8 certain circumstances; to specify an election for submission of the proposition to
9 electors; and provide a ballot proposition.
10 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
11 elected to each house concurring, that there shall be submitted to the electors of the state, for
12 their approval or rejection in the manner provided by law, a proposal to add Article VII,
13 Sections 18(G)(6), 21(K)(4) and (M)(4) of the Constitution of Louisiana, to read as follows:
14 §18. Ad Valorem Taxes

16	(G) Special Assessment Level.

18	(6)(a) A trust shall be eligible for the special assessment level as provided
19 by law.
20	(b) If a trust would have been eligible for the special assessment level
21 pursuant to this Subparagraph prior to the most recent reappraisal, the total
22 assessment of the property held in trust shall be the assessed value on the last
23 appraisal before the reappraisal.

1 §21. Other Property Exemptions
2 Section 21. In addition to the homestead exemption provided for in Section 20 of this
3 Article, the following property and no other shall be exempt from ad valorem taxation:

7	(4) A trust shall be eligible for the exemption provided for in this
8 Paragraph as provided by law.

10	(M) There is hereby established an exemption from ad valorem tax for the
11 total assessed value of the homestead of the unmarried surviving spouse of a person
12 who died under the conditions enumerated in Subsubparagraph (1)(a) or (b) of this
13 Paragraph, and if the conditions established in Subsubparagraph (1)(c) of this
14 Paragraph are met.

16	(4) A trust shall be eligible for the exemption provided for in this
17 Paragraph as provided by law.

19 Section 2.  Be it further resolved that this proposed amendment shall be submitted
20 to the electors of the state of Louisiana at the statewide election to be held on November 6,
21 2018.
22 Section 3.  Be it further resolved that on the official ballot to be used at said election
23 there shall be printed a proposition, upon which the electors of the state shall be permitted
24 to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
25 follows:
26	Do you support an amendment to extend eligibility for the following special
27	property tax treatments to property in trust:  the special assessment level for
28	property tax valuation, the property tax exemption for property of a disabled
29	veteran, and the property tax exemption for the surviving spouse of a person
30	who died while performing their duties as a first responder, active duty
