Provides that contracts for inmate telephone services must be awarded to the lowest bidder and prohibits the state from profiting from such contracts. (8/1/18) 1 AN ACT 2 To enact R.S. 15:765 and R.S. 39:1756, relative to telephone services at correctional 3 facilities; to provide relative to the negotiation of contracts for inmate telephone 4 services; to prohibit profit by the state or any governmental entity from contracts for 5 inmate telephone services; to require that contracts for inmate telephone services be 6 awarded to the lowest bidder; and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 15:765 is hereby enacted to read as follows: 9 §765. Telephone services at correctional facilities; profit by state or 10 governmental entities prohibited; compliance with procurement 11 code required 12 A. Any contract to provide telephone services to inmates incarcerated at 13 state or local correctional facilities: 14 (1) Shall be negotiated and awarded in a manner so as to provide for the 15 lowest reasonable costs to both the person placing the call and the recipient of 16 the call. 17 (2) Shall be negotiated and awarded in a manner so as to pay for any Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. All negotiations for procurement of telephone services at state or local 4 correctional facilities shall be in accordance with and subject to the 5 requirements for telecommunications procurement under the Louisiana 6 Procurement Code, R.S. 39:1751 et seq. 7 C. No provision for profit by or commissions to the state or any 8 governmental entity shall be included in any contract for telephone services 9 negotiated and awarded pursuant to this Section. 10 Section 2. R.S. 39:1756 is hereby enacted to read as follows: 11 §1756. Telephone services at correctional facilities; award to lowest bidder; 12 profit or commissions prohibited 13 A. Any contract to provide telephone services to inmates incarcerated at 14 state or local correctional facilities: 15 (1) Shall be negotiated and awarded in a manner so as to provide for the 16 lowest reasonable costs to both the person placing the call and the recipient of 17 the call. 18 (2) Shall be negotiated and awarded in a manner so as to pay for any 19 expenses of the Department of Public Safety and Corrections or other governing 20 authority for establishing and administering any necessary telephone contract. 21 B. Any contract to provide telephone services to inmates incarcerated at 22 state or local correctional facilities shall be subject to the bid requirements of 23 this Part and shall be awarded to the lowest bidder. 24 C. No provision for profit by or commissions to the state or any 25 governmental entity shall be included in any contract for telephone services 26 negotiated and awarded pursuant to this Section and R.S. 15:765. Clement Jr. DIGEST SB 200 Original 2018 Regular Session Bishop Proposed law provides that any contract to provide telephone services to inmates incarcerated at state or local correctional facilities: (1)Must be negotiated and awarded in a manner so as to provide for the lowest reasonable costs to both the person placing the call and the recipient of the call. (2)Must be negotiated and awarded in a manner so as to pay for any expenses of the Dept. of Public Safety and Corrections or other governing authority for establishing and administering any telephone contract. Proposed law provides that all negotiations for procurement of inmate telephone services are to be in accordance with and subject to the requirements for telecommunications procurement under present law (La. Procurement Code). Proposed law provides that any contract to provide inmate telephone services is subject to the bid requirements of present law and must be awarded to the lowest bidder. Proposed law provides that any contract for inmate telephone services negotiated and awarded pursuant to proposed law cannot include any provision for profit by or commissions to the state or any governmental entity.
