2018 Regular Session ENROLLED SENATE BILL NO. 24 BY SENATORS MILLS AND BISHOP 1 AN ACT 2 To amend and reenact R.S. 37:2703(15)(b) and 2709 and to enact R.S. 37:2703(15)(c), 3 relative to social work practice; to provide for an exception from licensure; to 4 provide for technical corrections; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 37:2703(15)(b) and 2709 are hereby amended and reenacted and R.S. 7 37:2703(15)(c) is hereby enacted to read as follows: 8 §2703. Definitions 9 As used in this Chapter, unless the context clearly requires otherwise, and 10 except as otherwise expressly provided: 11 * * * 12 (15) 13 * * * 14 (b) A faculty member who has obtained a master's degree or license in 15 a field other than social work and who teaches a course in a social work 16 program other than a clinical course, a clinical practicum, or any other course 17 involving the scope of practice of social work at an accredited Louisiana 18 institution of higher education shall not be construed as practicing social work 19 and shall not be subject to the provisions of this Chapter. 20 (c) Nothing in this Chapter shall be construed to authorize any person 21 licensed, certified, provisionally certified, or registered hereunder to prescribe, either 22 orally or in writing, distribute, dispense, or administer any medications. Nothing in 23 this Chapter shall be construed to authorize any social worker licensed, certified, 24 provisionally certified, or registered under this Chapter to administer or interpret 25 psychological tests, or to engage in the practice of psychology, as defined by the ACT No. 227 Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 24 ENROLLED 1 provisions of R.S. 37:2352(5) or to engage in the practice of medicine, as defined by 2 the provisions of R.S. 37:1262. Notwithstanding any provisions of R.S. 37:2352(5), 3 persons covered by this Chapter may, based upon scope of practice, administer, use, 4 or interpret tests of language, education and achievement, adaptive behavioral tests, 5 and symptom screening checklists instruments, as well as tests of abilities, interests, 6 and aptitudes. 7 * * * 8 §2709. License, certification, or registration required 9 A. No individual shall practice social work in the state unless the individual 10 holds a current, valid license, certificate, or registration issued by the board in 11 accordance with this Chapter. This license, certificate, or registration shall be kept 12 conspicuously posted in the office or place of business at all times. 13 B. An individual shall submit an application for licensure, certification, 14 or registration to the board within ninety days of commencement of social work 15 practice.
