SENATE BILL NO. 277

HEALTH CARE.  Provides relative to the Louisiana State Board of Medical Examiners.

1	AN ACT
2 To amend and reenact R.S. 37:1263(B)(3) and (F) and to enact R.S. 37:1285(J), relative to
3 investigations by the Louisiana State Board of Medical Examiners; to provide for
4 suspension, revocation, or imposition of restrictions; to provide for commencement
5 of disciplinary actions; to provide for submission of names to serve on the board; and
6 to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 37:1263(B)(3) and (F) are hereby amended and reenacted and R.S.
9 37:1285(J) is hereby enacted to read as follows:
10 §1263. Louisiana State Board of Medical Examiners; membership; qualifications;
11	appointment; removal; terms

13	B. Beginning on January 1, 2017, the board shall consist of seven voting
14 members, all appointed by the governor and subject to Senate confirmation as
15 follows:

17	(3) One non-physician member from a list of names submitted by the Tulane

1 Medical School chairmen of the senate and house committees on health and
2 welfare.

4	F. Except as provided in Paragraph (D)(3) of this Section, members of the
5 board shall be appointed for a term of four years, beginning on July first of the year
6 in which the appointment is made. No member shall serve more than three
7 consecutive terms. Notwithstanding the provisions of this Subsection, the
8 member of the board appointed under the provisions of Paragraph (B)(3) of this
9 Section shall serve only one term.

14	J. No disciplinary proceeding provided for in this Section shall
15 commence prior to a complaint being submitted to the board in accordance with
16 R.S. 37:1285.2.

Present law provides for membership on the LSBME. Present law provides for a member
appointed from a list of names submitted by Tulane Medical School. 
Proposed law repeals the appointment in present law and replaces the appointment with a
non-physician member appointed from a list of names submitted by the chairmen of the
senate and house committees on health and welfare.
Proposed law provides that the non-physician member provided for in proposed law shall
serve only one term.
Present law provides relative to investigations by the LSBME. Present law provides for the
procedure and causes for refusal to issue or revocation of any license or permit under its
authority.
Proposed law provides that no proceeding for disciplinary action may commence prior to
receipt by the board of a complaint as provided for in present law.
