Requires that the attorney general receive certain annual reports from the owners of self-service storage facilities. (8/1/18) 1 AN ACT 2 To enact R.S. 9:4759(15), relative to self-service storage facilities; to require owners of 3 self-service storage facilities to provide certain notifications to the attorney general; 4 to provide terms, conditions, and requirements; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 9:4759(15) is hereby enacted to read as follows: 7 ยง4759. Options of owner upon lessee's default 8 In the event of default by the lessee, the owner of a self-service storage 9 facility has the option to enforce judicially all of his rights under the rental 10 agreement, including, if the agreement so provides, his right to accelerate all rentals 11 that will become due in the future for the full term of the lease or to cancel the lease 12 and enforce his privilege for the debt due him, as follows: 13 * * * 14 (15) At the end of each year, the owner of a self-service storage facility 15 shall submit to the attorney general a report identifying each instance of default 16 by a lessee in which the owner has opted to enforce his rights as provided for in 17 this Section. DIGEST SB 290 Original 2018 Regular Session Barrow Present law provides that in the event of a default by a lessee, the owner of a self-service storage facility has the option to enforce all his rights under the rental agreement. Proposed law requires the owner of a self-service storage facility to annually report to the attorney general each instance of default by a lessee in which he has opted to enforce his rights as provided for in present law.
