ATTORNEY GENERAL:  Provides relative to legal representation by the Department of
Justice
1	AN ACT
2To amend and reenact R.S. 36:704(H), relative to the Department of Justice; to provide
3 relative to legal representation by the Department of Justice; to provide relative to
4 legal representation for postsecondary education institutions exempted from the
5 state's risk management program; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 36:704(H) is hereby amended and reenacted to read as follows: 
8 ยง704.  Divisions of the department; functions

10	H.  There shall be within the Department of Justice a litigation division.  It
11 shall be responsible for providing legal representation for the state, its officers,
12 agents, employees, boards, and commissions, pursuant to the provisions of Chapter
13 16 - A of Title 39 of the Louisiana Revised Statutes of 1950 and pursuant to R.S.
14 17:3139.5(B)(2)(e) for any institution granted an exemption from the state's risk
15 management program.

Abstract:  Adds postsecondary education institutions exempted from the state's risk
management program to those entities for whom the Dept. of Justice (DOJ) provides
legal representation.
Present law requires the DOJ to legally represent the state, its officers, agents, employees,
boards, and commissions.
Proposed law retains present law and adds postsecondary education institutions exempted
from the state's risk management program to the list of entities for whom the DOJ provides
legal representation.
