ENROLLED ACT No. 71 2019 Regular Session HOUSE BILL NO. 232 BY REPRESENTATIVE TURNER 1 AN ACT 2 To enact R.S. 47:490.32, relative to motor vehicle military honor license plates; to create a 3 military honor license plate for combat veterans; to provide for the creation, 4 issuance, design, fees, distribution, and rule promulgation applicable to such plates; 5 and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 47:490.32 is hereby enacted to read as follows: 8 ยง490.32. Military honor license plate for a "Combat Veteran" 9 A. The secretary of the Department of Public Safety and Corrections shall 10 establish a military honor license plate to be known as the "Combat Veteran" plate. 11 B. Upon application of a person presenting certification from the United 12 States Department of Veteran Affairs or the Louisiana Department of Veterans 13 Affairs that the applicant is a combat veteran, the secretary shall issue a military 14 honor license plate to be used in lieu of a regular motor vehicle registration plate. 15 The license plate shall be restricted to use on passenger cars, pickup trucks, 16 recreational vehicles, motorcycles, and vans. The military honor license plate shall 17 include the words "COMBAT VETERAN" centered on the bottom of the plate. The 18 colors of the plate shall be red, white, and blue. 19 C. The charge for the license plate shall be the standard motor vehicle 20 license tax imposed by Article VII, Section 5 of the Constitution of Louisiana as 21 provided in R.S. 47:463, and a handling fee of three dollars and fifty cents for each 22 plate to be retained by the department to offset a portion of administrative costs. The secretary shall adopt rules and regulations to implement the 2 provisions of this Section, including but not limited to rules governing the transfer 3 of license plates from one vehicle to another and the disposition of such license 4 plates. 5 E.(1) Any applicant who qualifies for the military honor license plate 6 authorized by this Section may be issued a plate for each vehicle registered in the 7 applicant's name. 8 (2) Except as otherwise provided in this Paragraph, each military honor 9 license plate issued pursuant to this Section shall be returned to the secretary upon 10 the death of the person to whom the plate was issued. The surviving spouse of the 11 person issued a military honor license plate pursuant to this Section may retain the 12 plate, provided the surviving spouse has not remarried and applies to the secretary 13 for a transfer of the plate. A military honor license plate transferred pursuant to this 14 Paragraph to a surviving spouse shall be returned to the secretary upon the death or 15 remarriage of the surviving spouse. 16 Section 2. The Department of Public Safety and Corrections, office of motor 17 vehicles, is hereby directed to create the special prestige license plate when the applicable 18 statutory provisions are met and its system is updated to accommodate the creation of new 19 plates.
