HEALTH CARE/FACILITIES:  Provides relative to definitions and licensure requirements
provided in the Ambulatory Surgical Centers Licensing Law
1	AN ACT
2To amend and reenact R.S. 40:2133(A)(2) and 2139(A), to enact R.S. 40:2134.1, and to
3 repeal R.S. 40:2139(B), relative to ambulatory surgical centers; to include a certain
4 type of health facility within the definition of ambulatory surgical center; to provide
5 relative to the requirement for ambulatory surgical center licensure; to provide for
6 terms of validity of ambulatory surgical center licenses; to provide relative to the fee
7 for an ambulatory surgical center license; and to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 40:2133(A)(2) and 2139(A) are hereby amended and reenacted and
10R.S. 40:2134.1 is hereby enacted to read as follows: 
11 §2133.  Definitions

14	(2)  "Ambulatory surgical center" also means any of the following:
15	(a)  A a treatment center that is operated primarily for the purpose of offering
16 stereotactic radiosurgery by use of a Gamma Knife or similar neurosurgical tool.
17	(b)  A treatment center that is operated primarily for the purpose of offering
18 endovascular surgical services that include, but are not limited to, interventional

1 radiology or vascular access procedures utilizing a percutaneous approach or
2 intervention.

4 §2134.1.  License required; terms of validity; posting of license at licensed facility
5	A.  No ambulatory surgical center may be established or operated without a
6 license issued by the licensing agency.
7	B.  A license issued to an ambulatory surgical center shall be valid for only
8 one geographic location and shall be issued only for the person and premises named
9 in the license application.
10	C.  A license issued pursuant to this Part is valid for a period of up to twelve
11 months, beginning the month of issuance, unless revoked or otherwise suspended.
12	D.  A license issued pursuant to this Part shall not be transferable or
13 assignable.
14	E.  Each ambulatory surgical center licensed pursuant to this Part shall post
15 its license in a conspicuous place on the licensed premises.

17 §2139.  Fees and limitations
18	A.  The application by any person for a license or renewal of a license to
19 operate an ambulatory surgical center shall be accompanied by a fee of five hundred
20 dollars in the amount required by R.S. 40:2006 which is hereby levied as the license
21 fee for operation of an ambulatory surgical center for a period of one year; provided
22 ambulatory surgical centers subject to the licensing requirements of this Part which
23 are owned and operated by the state of Louisiana shall be exempt from payment of
24 the fees stipulated in this Section.  The fees herein levied and collected shall be paid
25 into the general fund.
26 Section 2.  R.S. 40:2139(B) is hereby repealed in its entirety.

Abstract:  Includes endovascular surgical centers within the definition of "ambulatory
surgical center" and provides relative to the requirement for ambulatory surgical
center licensure.
Present law defines "ambulatory surgical center" and provides for licensure of such centers
by the La. Department of Health.
Proposed law retains present law and expands the definition of "ambulatory surgical center"
to include treatment centers that are operated primarily for the purpose of offering
endovascular surgical services that include, but are not limited to, interventional radiology
or vascular access procedures utilizing a percutaneous approach or intervention.
Present law, R.S. 40:2139, provides that the application fee for an ambulatory surgical center
license is $500.  Present law, R.S. 40:2006(A), provides that the amount of the application
fee shall not exceed $600.  Proposed law repeals present law providing for the $500 license
fee and retains present law providing that the application fee for an ambulatory surgical
center license shall not exceed $600.
Proposed law retains and relocates provisions of present law relative to ambulatory surgical
center licensure requirements, terms of validity of licenses, transferability and assignability
of licenses, and a requirement that licenses be posted at licensed facilities.
