SEWERAGE:  Provides for remote monitoring of certain sewerage facilities
1	AN ACT
2To enact R.S. 30:2078, relative to sewage overflows; to provide for certain compliance
3 orders issued by the Department of Environmental Quality; to require the installation
4 of remote monitoring; to provide for rules and regulations; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 30:2078 is hereby enacted to read as follows:
8 ยง2078.  Sewage overflows; remote monitoring requirements
9	If the department issues a compliance order for a violation of this Chapter
10 that resulted in a sewage overflow that was caused or substantially caused from a
11 failure in the same lift station more than five times in a twelve month period, the
12 order shall require the installation of remote monitoring equipment.  Such an order
13 shall provide for a reasonable time for the installation of the required remote
14 monitoring equipment.  The  provisions of this Section shall be in addition to any
15 other enforcement actions authorized by this Subtitle.  The secretary may adopt and
16 promulgate rules and regulations in accordance with the Administrative Procedure
17 Act necessary to implement the provisions of this Section.

Abstract:  Requires the installation of remote monitoring equipment on certain failing
sewage lift stations.
Present law grants the secretary of the Dept. of Environmental Quality the duty to prepare
and develop a general plan for the protection and control of the waters of the state, including
the permitting of sewage treatment facilities.
Proposed law requires the issuance of a compliance order that requires the installation of
remote monitoring equipment when the violation of present law resulted in a sewage
overflow caused or substantially caused from a failure in the same lift station more than five
times in a 12 month period.
Proposed law requires the order provide for a reasonable time for the installation of the
required remote monitoring equipment.
Proposed law authorizes the secretary to adopt and promulgate rules and regulations in
accordance with the APA necessary to implement the provisions of proposed law.
