HOUSE BILL NO. 368
BY REPRESENTATIVE MOSS
1	AN ACT
2 To amend and reenact R.S. 37:2405(A)(9) and to enact R.S. 37:2405(B)(15) and (D),
3 relative to the Louisiana Physical Therapy Board; to provide for the powers, duties,
4 and limitations of the board; to provide for the collection of a core set of data
5 elements; to provide for the creation of a healthcare workforce database; to provide
6 for agreements the board may enter into with private or public entities to maintain
7 such database; to provide for reports of allegations of professional sexual
8 misconduct; to provide for training of the board and staff members relative to
9 mistreatment by licensees; and to provide for related matters.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 37:2405(A)(9) is hereby amended and reenacted and R.S.
12 37:2405(B)(15) and (D) are hereby enacted to read as follows:
13 ยง2405.  Powers and duties of the board; limitation
14	A. The responsibility for enforcement of the provisions of this Chapter is
15 hereby vested in the board, which shall have all the powers, duties, and authority
16 specifically granted by or necessary for the enforcement of this Chapter, including:

18	(9)(a)  Reporting annually to the governor and to the presiding officer of each
19 house of the legislature on the condition of the practice of physical therapy in the
20 state, making recommendations for improvement of the practice of physical therapy
21 or the operation of the board, and submitting a record of the proceedings of the board
22 during the year, together with the names of all physical therapists and physical
23 therapist assistants to whom the board issued licenses during the year.

1	(b)  The report shall also include the number of complaints received by the
2 Physical Therapy Board regarding allegations of professional sexual misconduct  and
3 the status of each complaint.
4	B.  The board may:

6	(15)  Determine and collect, at the time of new licensure and licensure
7 renewal, a core set of data elements deemed necessary for the purpose of workforce
8 planning.  The data elements shall be used to create and maintain a healthcare
9 workforce database. The board may enter into agreements with a private or public
10 entity to establish and maintain the database, perform data analysis, and prepare
11 reports concerning the physical therapy workforce.  The board shall promulgate rules
12 to perform duties pursuant to this Paragraph.

14	D. The Board shall:
15	(1) Submit to a review of its disciplinary process and procedures by the state
16 inspector general or by an independent qualified external auditor recommended by
17 the state inspector general at least every five years.
18	(2) Require training of all board members and staff members in effective
19 communication with complainants, particularly members of vulnerable populations
20 who allege mistreatment by licensees.
