HOUSE BILL NO. 412

PUBLIC ASSISTANCE:  Provides relative to certain public assistance programs
1	AN ACT
2To amend and reenact R.S. 46:460.4(A) and (C) and 979.4(C), (G)(introductory paragraph),
3 and (1) and to repeal R.S. 46:460.4(D) and 979.4(I), relative to certain public
4 assistance programs; to provide relative to laws for reforms of such programs; to
5 provide for services for enrollees in such programs; to provide relative to
6 requirements of enrollees in such programs; to repeal provisions for reporting on
7 such programs; to repeal provisions requiring the legislature to adjust funding for
8 such programs; and to provide for related matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 46:460.4(A) and (C) and 979.4(C), (G)(introductory paragraph), and
11(1) are hereby amended and reenacted to read as follows: 
12 §460.4.  Educational opportunities Opportunities to promote self-sufficiency
13	A.  The legislature hereby finds that an employment-focused program has
14 succeeded in reducing welfare rolls by focusing on can be successful in conveying
15 the importance of work as a way of escaping poverty; education and employment can
16 give welfare recipients people the literacy, knowledge, and aptitudes to obtain and
17 retain private career-path employment; that these programs retain their importance
18 in reducing welfare dependency on government benefits; that new federal legislation
19 places federal policies have placed an increased emphasis on employment and allows
20 allowed the combining of employment-related activities with educational activities;

1 and that to the extent that they can be funded under the new a federal welfare reform
2 program without hindering the other federally recognized goals, they should be
3 funded.
4	C.  Within this Section, "educational activities" refers to any of the following
5 educational activities funded by the Department of Children and Family Services in
6 the state 1995-96 Fiscal Year, but not countable towards the federal participation
7 requirements of 42 U.S.C. 407 as amended in 1996 and services:
8	(1)  Courses for obtaining general high school equivalency degrees diplomas.
9	(2)  Adult basic education and literacy training.
10	(3)  Vocational-technical Vocational and technical training.

12 §979.4.  Administration of the Louisiana First America Next Freedom and
13	Empowerment Plan

15	C.  The department may work with any other state department agency in
16 order to seek to effect the plan's purposes, and shall do so with all deliberate speed
17 so as in order to effect these health care healthcare reforms in a timely manner.

19	G.  An eligible individual offered health insurance access, enrolled in health
20 insurance coverage, or allowed to create a health savings account, shall affirmatively
21 be required to acknowledge the existence of all of the following facts:
22	(1)  The plan shall not be is not a perpetual federal or state right or guaranteed
23 entitlement.
