UTILITY/ELEC COOPS:  Provides for the jurisdiction of the Public Service Commission
with respect to electricity cooperatives
1	AN ACT
2To amend and reenact R.S. 12:426(A), relative to electricity cooperatives; to provide with
3 respect to the jurisdiction of the Public Service Commission; and to provide for
4 related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 12:426(A) is hereby amended and reenacted to read as follows: 
7 ยง426.  Jurisdiction of the Public Service Commission 
8	A.  Cooperatives transacting business in this state pursuant to this Part shall
9 not be subject to the jurisdiction and control of the Public Service Commission
10 except as provided in R.S. 45:1163 and Subsections B and C of this Section.

Abstract:  Provides with respect to the jurisdiction of the Public Service Commission as it
relates to electricity cooperatives.
Present law provides that cooperatives that transact business in the state shall not be subject
to the jurisdiction of the Public Service Commission (PSC) except as it relates to the
authority to regulate rates and unless the members hold a referendum election to determine
otherwise pursuant to present law.

Proposed law changes present law by providing that cooperatives transacting business in the
state shall be subject to the jurisdiction of the PSC except as it relates to the authority to
regulate rates and unless the members hold a referendum election to determine otherwise
pursuant to present law. 
Present law provides that a petition of at least ten percent of the members of an electric
cooperation is necessary in order to hold a referendum election to determine whether the
electric cooperative shall be subject to the jurisdiction of the PSC.
Proposed law retains present law.
