DENTISTRY:  Provides relative to the membership of the Louisiana State Board of
Dentistry
1	AN ACT
2To amend and reenact R.S. 37:753(C)(2), relative to the membership of the Louisiana State
3 Board of Dentistry; to require that an appointee to an at-large seat on the board
4 possess certain qualifications; to provide for filling of a vacancy in the at-large seat;
5 and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 37:753(C)(2) is hereby amended and reenacted to read as follows: 
8 ยง753.  Louisiana State Board of Dentistry; appointment of members; term of office;
9	vacancies; nominating meetings; quorum; domicile

11	C.  Each member of the board shall be appointed by the governor as follows:

13	(2)  Three dentists shall be appointed from the state at large. to fill seats
14 designated as "At-Large Seats A, B, and C" in accordance with the following
15 requirements:
16	(a)  One seat shall be designated as "At-Large Seat A" and shall be appointed
17 from the state at large from a list of three licensed black dentists certified by the
18 board secretary to the governor.  The board secretary shall obtain a list of three
19 nominees for the "At-Large Seat A" position by ballot sent by United States mail to
20 all licensed black dentists in the state at their last known mailing address as indicated

1 in the board files.  Each licensed black dentist may nominate any three licensed black
2 dentists by completing the ballot with the full name, residence, address, city, and
3 home telephone number of the three nominees and mailing the ballot to the board
4 offices.  The submission of such information on the ballot shall serve as confirmation
5 that the voter has discussed the nomination with the nominees and they have agreed
6 to serve if nominated and appointed by the governor.  The ballot shall be mailed by
7 the board secretary at least ninety days prior to any vacancy occurring by reason of
8 an expiring term or within thirty days after a vacancy occurring by reason of death,
9 resignation, or for any other reason.  After the board secretary has tabulated all
10 ballots received at the board offices, the names of the three nominees receiving the
11 greatest number of votes shall be certified by the secretary and sent to the governor.
12	(b)  Two seats One seat shall be designated as "At-Large Seats B and C Seat
13 B" and shall be appointed from a roster of all licensed dentists in the state.  A
14 vacancy occurring in either "At-Large Seat B" or "At-Large Seat C" shall be filled
15 by the governor without the necessity of a nomination or other requirement, except
16 that the appointee shall be licensed and domiciled in the state.
17	(c)  One seat shall be designated as "At-Large Seat C" and shall be appointed
18 from a roster of all licensed dentists in the state who are board-eligible or board-
19 certified oral and maxillofacial surgeons, all licensed dentists in the state who are
20 board-eligible or board-certified dental anesthesiologists, and all licensed dentists in
21 the state who have comparable training and expertise as defined by the Louisiana
22 State Board of Dentistry in deep sedation and anesthesia.  A vacancy occurring in
23 "At-Large Seat C" shall be filled by the governor without the necessity of a
24 nomination or other requirement, except that the appointee shall be licensed and
25 domiciled in the state and additionally shall be qualified as a board-eligible or
26 board-certified oral and maxillofacial surgeon, a board-eligible or board-certified
27 dental anesthesiologist, or a dentist who has comparable training and expertise as
28 defined by the Louisiana State Board of Dentistry in deep sedation and anesthesia.

Abstract:  Provides that one member of the La. State Board of Dentistry shall be qualified
as a board-eligible or board-certified oral and maxillofacial surgeon, a board-eligible
or board-certified dental anesthesiologist, or a dentist who has comparable training
and expertise in deep sedation and anesthesia.
Present law creates and provides for the membership of the La. State Board of Dentistry.
Proposed law requires that the appointee to a certain at-large seat on the board (At-Large
Seat C) be one of the following types of licensed dentist:
(1)A board-eligible or board-certified oral and maxillofacial surgeon.
(2)A board-eligible or board-certified dental anesthesiologist.
(3)A dentist who has comparable training and expertise, as defined by the La. State
Board of Dentistry, in deep sedation and anesthesia.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Health and Welfare to
the original bill:
1. Provide that, in addition to board-eligible or board-certified oral and
maxillofacial surgeons, the following dentists may be eligible to hold At-Large
Seat C on the of the La. State Board of Dentistry:
a. Board-eligible or board-certified dental anesthesiologists.
b. All licensed dentists in the state who have comparable training and
expertise, as defined by the La. State Board of Dentistry, in deep sedation
and anesthesia.
