HOUSE BILL NO. 73

CRIME:  Provides with respect to the reporting of burn injuries and wounds
1	AN ACT
2To amend and reenact R.S. 14:403.4(D)(2) and to enact R.S. 14:403.4(C)(3), relative to
3 reports of burn injuries and wounds; to authorize the office of state fire marshal to
4 request reports of burn injuries or wounds; to require the report to be made available
5 to the office of state fire marshal when requested; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 14:403.4(D)(2) is hereby amended and reenacted and R.S.
814:403.4(C)(3) is hereby enacted to read as follows:

13	(3)  The office may, at any time, request a hospital, burn center, sanitarium,
14 or other medical facility to provide the office with reports of burn injuries or wounds
15 of any nature, degree, or percentage of the body.  Such reports shall be made
16 available to the office upon request.

19	(2)  The office of state fire marshal may adopt rules and regulations as may
20 be necessary in carrying out the provisions of this Section.  Specifically such Such

1 rules shall provide for cooperation with local investigatory and law enforcement
2 agencies and may also authorize law enforcement personnel and the state fire
3 marshal to review those medical records of reported victims that relate to the burn
4 without the consent of the victim.

Abstract:  Authorizes the office of state fire marshal to request reports of burn injuries or
wounds from a hospital, burn center, sanitarium, or other medical facility.
Present law requires the reporting of cases of burn injuries or wounds in which a victim
sustains second or third degree burns to five percent of the body or any burns to the upper
respiratory tract or laryngeal edema due to the inhalation of super-heated air, and in cases
that may result in death, to the office of state fire marshal.
Present law further requires a report to be made within two hours of initial examination or
treatment of the victim by a physician attending or treating the case, or by a manager,
superintendent, director, or other person in charge when the case is treated in a hospital, burn
center, sanitarium, or other medical facility.
Proposed law authorizes the office of state fire marshal to request reports of burn injuries or
wounds, of any nature, degree, or percentage of the body, from a hospital, burn center,
sanitarium, or other medical facility.  Further requires the report to be made available to the
office when requested.
