HOUSE BILL NO. 91

LOCAL OFFL/MARSHALS:  Provides relative to the salary of the marshal of the city of
Hammond
1	AN ACT
2To enact R.S. 13:1883.1 and to repeal R.S. 13:5807.2,  relative to the collection and use of
3 fees and commissions by the marshal of the city of Hammond; to provide for the
4 salary of the marshal of the city of Hammond; to provide for the use of collected fees
5 and commissions for operational expenses of the office; and to provide for related
6 matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 13:1883.1 is hereby enacted to read as follows: 
9 ยง1883.1.  Compensation of marshal
10	The marshal of the city of Hammond is authorized to use up to thirty-nine
11 thousand five hundred eighty-six dollars of the fees and commissions collected by
12 his office to supplement his salary and benefits.  The total compensation and benefits
13 paid to the marshal of the city of Hammond shall not exceed one hundred eleven
14 thousand five hundred eighty-five dollars annually. The remainder of the fees and
15 commissions collected shall be used to defray operational expenses of the office as
16 may be useful and necessary for the proper conduct of the office of the marshal.
17 Section 2.  R.S. 13:5807.2 is hereby repealed in its entirety.
18 Section 3.  This Act shall become effective upon signature by the governor or, if not
19signed by the governor, upon expiration of the time for bills to become law without signature
20by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract:  Provides for the use of fees and commissions for a maximum salary for the
marshal of the city of Hammond.
Present law (R.S. 13:1883(A)(5)) provides that the salary of the marshal of the City Court
of Hammond shall be paid by the governing authorities of the city and parish. Present law
also provides for a schedule of costs to be collected by marshals.
Proposed law provides that the salary of the marshal for the city of Hammond cannot exceed
$111,585 annually. Authorizes the marshal to use up to $39,586 of the fees collected to
supplement his salary and the remainder of the salary shall be paid by the governing
authorities of the city and parish. Provides that the remainder of the fees can be used for
operational expenses for the office of the marshal. 
Effective upon signature of governor or lapse of time for gubernatorial action.
