HOUSE CONCURRENT RESOL UTION NO. 32
BY REPRESENTATIVES HORTON, AMEDEE, BAGLEY, CREWS, EDMONDS, AND
FALCONER
TAX/SALES & USE:  Suspends the .45% state sales and use tax levy imposed in R.S.
47:321.1 until 60 days after final adjournment of the 2020 R.S.
1	A CONCURRENT RESOL UTION
2To suspend until sixty days after final adjournment of the 2020 Regular Session of the
3 Legislature of Louisiana the provisions of R.S. 47:321.1 that provides for the levy
4 of forty-five hundredths of one percent of state sales and use taxes.
5 WHEREAS, prior to the 2018 Regular and Extraordinary Sessions of the Legislature,
6the state deficit for Fiscal Year 2018-2019 was forecasted to be $1.5 billion; and
7 WHEREAS, the state's financial situation at the time of enacting R.S. 47:321.1
8required an increase in revenue for the state, including an increase in tax collections to help
9avert the $1.5 billion fiscal cliff; and
10 WHEREAS, Act No. 26 of the 2016 First Extraordinary Session of the Legislature
11enacted R.S. 47:321.1, which levied a state sales and use tax at the rate of one percent
12through June 30, 2018, which was projected to increase revenue collection of the state; and
13 WHEREAS, notwithstanding the fact that the sales tax levy in R.S. 47:321.1 was set
14to expire on June 30, 2018, during the 2018 Third Extraordinary Session of the Legislature
15Act No. 1 enacted a state sales tax levied in R.S. 47:321.1 at the rate of forty-five hundredths
16of one percent which will expire on June 30, 2025; and
17 WHEREAS, after the temporary sales tax was implemented, the state finished Fiscal
18Year 2017-2018 with a State General Fund surplus of $308,053,201; and
19 WHEREAS, at the April 10, 2019, Revenue Estimating Conference meeting the
20revenue estimate for Fiscal Year 2018-2019 was increased by $110 million; and

1 WHEREAS, at the April 10, 2019, Revenue Estimating Conference meeting the
2revenue estimate for Fiscal Year 2019-2020 was increased by $119.3 million; and
3 WHEREAS, the state is in a better financial situation and no longer needs the
4additional .45% of state sales and use taxes collected from the citizens of this state, who
5deserve a break from state sales and use taxes.  
6 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby suspends
7the provisions of R.S. 47:321.1 that provides for the levy of forty-five hundredth of one
8percent of state sales and use taxes.
9 BE IT FURTHER RESOLVED that this suspension shall become effective upon
10adoption of this Resolution and shall extend through the sixtieth day after final adjournment
11of the 2020 Regular Session of the Legislature of Louisiana.

consumption in this state of each item or article of tangible personal property.
