ENROLLED 2019 Regular Session HOUSE CONCURRENT RESOL UTION NO. 48 BY REPRESENTATIVE FOIL AND SENATORS THOMPSON AND W ALSWORTH A CONCURRENT RESOL UTION To urge and request the Louisiana Department of Health to study the feasibility and desirability of implementing a policy to allow the use of monitoring devices in the rooms of residents of intermediate care facilities for people with developmental disabilities, and to report findings of the study to the legislative committees on health and welfare. WHEREAS, intermediate care facilities for people with developmental disabilities, referred to hereafter as "ICF/DD", are facilities that provide services to individuals with developmental or intellectual disabilities who require twenty-four hours of care per day in community, group, or residential home settings; and WHEREAS, ICF/DDs are licensed and regulated by the Louisiana Department of Health in accordance with the provisions of R.S. 40:2180 et seq.; and WHEREAS, ensuring the health and safety of ICF/DD residents is a vitally important duty of this state; and WHEREAS, Louisiana law, R.S. 40:1193.1 et seq., authorizes the use of monitoring devices, subject to certain conditions and requirements, in the rooms of residents of other types of institutional facilities in which vulnerable populations receive care; however, the use of such devices in the ICF/DDs of this state is not yet authorized in statute or rule. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the Louisiana Department of Health to study the feasibility and desirability of implementing a policy to allow the use of monitoring devices in the rooms of residents of intermediate care facilities for people with developmental disabilities. BE IT FURTHER RESOLVED that in developing the study called for in this Resolution, the department shall engage, collaborate with, and obtain information and Page 1 of 2 HCR NO. 48 ENROLLED perspective from stakeholder organizations including, without limitation, the governor's office of disability affairs and the Louisiana Developmental Disabilities Council. BE IT FURTHER RESOLVED that the department shall submit a written report of its findings resulting from the study requested in this Resolution to the House Committee on Health and Welfare and the Senate Committee on Health and Welfare on or before March 31, 2020. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the secretary of the Louisiana Department of Health, the executive director of the governor's office of disability affairs, and the executive director of the Louisiana Developmental Disabilities Council.
