ENROLLED 2019 Regular Session HOUSE CONCURRENT RESOL UTION NO. 52 BY REPRESENTATIVE LYONS A CONCURRENT RESOL UTION To urge and request the Louisiana Commission on Law Enforcement and Administration of Criminal Justice (LCLE) to develop a platform or means through which data and information is collected from law enforcement agencies utilizing body cameras and distributed to other law enforcement agencies. WHEREAS, in order to safeguard the public and peace officers of this state, it is vital for local peace officers and the communities they protect to have strong, collaborative relationships; and WHEREAS, the implementation of the use of body cameras by all law enforcement agencies will assist in the documentation of evidence to better serve the community which would assist in the building of a strong and collaborative relationship; and WHEREAS, trust between law enforcement agencies and the citizens they serve is essential to the stability of communities, the integrity of the criminal justice system, and the safe and effective delivery of public safety services; and WHEREAS, the implementation of the use of body cameras by all law enforcement agencies will assist in preventing and resolving complaints brought by members of the public against peace officers, strengthening law enforcement transparency, performance, and accountability, and the documenting of evidence; and WHEREAS, body cameras may assist law enforcement agencies in identifying and correcting problems within their agencies by using footage from the cameras to provide scenario-based training, evaluate the performance of new officers in the field, and identify new areas in which training may be needed; and WHEREAS, in determining whether to utilize body cameras, a law enforcement agency must consider a number of factors including but not limited to compliance with existing laws, the cost and feasibility of implementation, the adoption of policies and Page 1 of 2 HCR NO. 52 ENROLLED procedures to regulate the use of the body cameras, the storage of data from the body cameras, and the retention of data and records related to the body cameras; and WHEREAS, in making this determination, information from other law enforcement agencies that currently utilize body cameras is vital, and the development of a platform by which law enforcement agencies can share information and experiences with respect to the use of body cameras would be a valuable resource for all law enforcement agencies. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the Louisiana Commission on Law Enforcement and Administration of Criminal Justice (LCLE) to develop a platform or means through which law enforcement agencies can share and exchange non-confidential information and experiences with respect to body cameras including but not limited to the following: (1) Policies and procedures for the proper use, maintenance, and storage of body cameras, which shall include recommendations on policies and procedures for the use of body cameras while the law enforcement officer is engaged in the performance of his official duties. (2) Policies and procedures regarding proper storage, retention, and release of audio and video data recorded by body cameras as well as establishing a time frame to review the data recorded by body cameras. (3) Policies and procedures regarding the law enforcement training relative to each enforcement agency's policies and procedures on the use of body cameras. (4) Legislation needed, if any, to authorize the use of body cameras by peace officers in this state.
