HOUSE RESOLUTION NO. 303

A RESOLUTION
To create and establish the Wireless Telecommunications and Vehicle Safety Study
Commission to study the use of a wireless telecommunications device while
operating a motor vehicle.
WHEREAS, the use of wireless telecommunications devices while operating a motor
vehicle is becoming an epidemic within the state of Louisiana; and
WHEREAS, using a wireless telecommunications device while operating a vehicle
is one of the top distractions for drivers traversing the roadways throughout the country; and
WHEREAS, a person cannot travel on any road within this state without noticing
someone using a wireless telecommunications device while operating a motor vehicle; and
WHEREAS, numerous accidents, including fatalities, have occurred due to people
being distracted while driving using their wireless telecommunications device while
operating a motor vehicle; and
WHEREAS, House Bill No. 229 of the 2019 Regular Session proposed regulating
the use of a wireless telecommunications device while operating a motor vehicle; and
WHEREAS, if enacted, House Bill No. 229 would have provided for changes and
additions to current provisions of law regulating the use of a wireless telecommunications
device while operating a motor vehicle; and
WHEREAS, further inquiry and investigation is necessary to fully develop the
necessary changes and additions to current provisions regulating the use of a wireless
telecommunications device while operating a motor vehicle.
THEREFORE, BE IT RESOLVED that the House of Representatives of the
Legislature of Louisiana does hereby create the Wireless Telecommunications and Vehicle
Safety Study Commission to study the use of a wireless telecommunications device while
operating a motor vehicle and provide recommendations for changes and additions to current

provisions of law regulating the use of a wireless telecommunications device while operating
a motor vehicle.
BE IT FURTHER RESOLVED that the study commission shall be composed of the
following members:
(1)  The secretary of the Department of Public Safety and Corrections or his
designee.
(2)  A representative of the Department of Public Safety and Corrections, office of
state police as appointed by the superintendent.
(3)  The president of the Louisiana Sheriffs' Association or his designee.
(4)  The president of the Louisiana Association of Chiefs of Police or his designee.
(5)  The chief executive officer of StopDistractions.org or his designee.
BE IT FURTHER RESOLVED that, at a minimum, the commission shall study the
following:
(1)  The magnitude of the problem.
(2)  Crash types involving the use of a wireless telecommunications device while
operating a motor vehicle, whether fatal or non-fatal, single vehicle or multiple vehicle, and
the age of the people or person involved.
(3)  Contrast crash types involving the use of a wireless telecommunications device
while driving as opposed to crash types that do not involve the use of a wireless
telecommunications device while driving.
(4)  Strategies that have the potential for reducing the use of a wireless
telecommunications device while operating a motor vehicle.
BE IT FURTHER RESOLVED that the study commission shall submit a report
detailing the results of its study, along with its recommendations, to the legislature prior to
February 1, 2020.
BE IT FURTHER RESOLVED that the Wireless Telecommunication and Vehicle
Safety Study Commission shall cease on February 28, 2020.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
secretary of the Department of Public Safety and Corrections, the superintendent of the
Department of Public Safety and Corrections, office of state police, the president of the

Louisiana Sheriffs' Association, the president of the Louisiana Association of Chiefs of
Police, and the chief executive officer of StopDistractions.org.
