LOCAL FINANCE.  Provides relative to tax and tax renewal elections in parishes within
certain populations. (gov sig)
1	AN ACT
2 To enact R.S. 18:1296, relative to local taxation; to provide for parish and political
3 subdivision tax and tax renewals in certain parishes; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 18:1296 is hereby enacted to read as follows:
7 ยง1296.  Tax and tax renewal elections in certain parishes; applicability to
8	municipalities within the parish
9	A. Except as provided in the Constitution of Louisiana and this Section,
10 and notwithstanding any other contrary provision of law, in parishes with a
11 population of more than four hundred thousand persons according to the latest
12 federal decennial census, a parish or other political subdivision tax or tax
13 renewal approved at an election held for that purpose shall only apply within
14 a municipality located in the parish or political subdivision if a majority of the
15 electors of the municipality voting on the tax or tax renewal approved it.
16	B.  The provisions of this Section shall not apply to elections for taxes or
17 tax renewals for the purpose of funding the following parishwide services:

1 sheriffs, other parishwide law enforcement services, and emergency medical
2 services.
3 Section 2.  This Act shall become effective upon signature by the governor or, if not
4 signed by the governor, upon expiration of the time for bills to become law without signature
5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
6 vetoed by the governor and subsequently approved by the legislature, this Act shall become
7 effective on the day following such approval.

Proposed law provides that except as provided in the Constitution of Louisiana and
notwithstanding any contrary provision of law, in parishes with a population of more than
400,000 persons according to the latest federal decennial census, a parish or other political
subdivision tax or tax renewal approved at an election held for that purpose shall only apply
within a municipality located in the parish or other political subdivision if a majority of the
municipal electors voting on the tax or tax renewal approved it.
Proposed law further provides that proposed law will not apply to elections for taxes or tax
renewals for the purpose of funding sheriffs, other parishwide law enforcement services, and
emergency medical services.
Effective upon signature of the governor or lapse of time for gubernatorial action.
