HOUSE BILL NO. 19
BY REPRESENTATIVES PRESSLY AND EDMONDS
1	AN ACT
2 To amend and reenact R.S. 51:2453(2)(c)(i) and to enact R.S. 51:2453(2)(b)(ix), relative to
3 the Quality Jobs Program; to authorize certain businesses to participate in the Quality
4 Jobs Program; to provide for effectiveness; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 51:2453(2)(c)(i) is hereby amended and reenacted and R.S.
7 51:2453(2)(b)(ix) is hereby enacted to read as follows: 
8 ยง2453.  Definitions
9	The following words or terms as used in this Chapter shall have the following
10 meaning, unless a different meaning appears from the context:

14	(b)  To qualify for a contract pursuant to this Chapter, employers must meet
15 one of the following provisions:

17	(ix)  The employer is a COVID-19-impacted retail business that has no more
18 than fifty employees nationwide including affiliates on the date of the filing of the
19 advance notification and which is assigned a North American Industry Classification
20 Code of 44, 45, 721, or 722 and the COVID-19-impacted retail business files or
21 enters into an advance notification on or after July 1, 2020, and on or before
22 December 31, 2021.  However, no COVID-19-impacted retail business employer
23 assigned a North American Industry Classification Code of 44, 45, 721, or 722 shall
24 be eligible to earn benefits pursuant to the provisions of this Chapter after June 30,
25 2023.  For purposes of this Section, "COVID-19-impacted retail business" means a

1 for-profit corporation, a limited liability company, a partnership, or a sole
2 proprietorship that had a physical and active operation in Louisiana on March 13,
3 2020, and ceased operations due to either one of the governor's public health
4 emergency proclamations or a mayor's proclamation or executive order related to the
5 public health emergency, or a decrease in customer activity or the inability to retain
6 sufficient staff due to the COVID-19 public health emergency.
7	(c)  The following employers or persons engaged in the following professions
8 or service industries shall not be eligible for any rebate under this Chapter:
9	(i)(aa)  Retail employers as identified by the North American Industry
10 Classification System code sections 44 and 45.
11	(bb) Notwithstanding the provisions of Subitem (aa) of this Item,
12 COVID-19-impacted retail employers identified by the North American Industry
13 Classification Code of 44 and 45 that have no more than fifty employees nationwide
14 including affiliates on the date of the filing of the advance notification shall be
15 eligible to participate in this rebate program if such employers file or enter into an
16 advance notification on or after July 1, 2020, and on or before December 31, 2021.
17 However, no COVID-19-impacted retail business employer assigned a North
18 American Industry Classification Code of 44 and 45 shall be eligible to earn benefits
19 pursuant to the provisions of this Chapter after June 30, 2023.

21 Section 2.  This Act shall become effective on July 1, 2020; if vetoed by the governor
22 and subsequently approved by the legislature, this Act shall become effective on July 1,
23 2020, or on the day following such approval by the legislature, whichever is later.
