HLS 201ES-17 ORIGINAL 2020 First Extraordinary Session HOUSE CONCURRENT RESOL UTION NO. 3 BY REPRESENTATIVE MARCELLE FUNDS/FUNDING: Provides relative to the Medicaid Trust Fund for the Elderly (Item #13) 1 A CONCURRENT RESOL UTION 2To make the principal amount in the Medicaid Trust Fund for the Elderly available for 3 appropriation for Fiscal Year 2020-2021. 4 WHEREAS, the Medicaid Trust Fund for the Elderly was established in the 2000 5First Extraordinary Session of the Legislature as a permanent trust fund in the state treasury, 6with spending of the principal of the fund limited to specific purposes, including the re- 7basing of nursing homes in accordance with the approved state Medicaid plan; and 8 WHEREAS, R.S. 46:2691(B) provides that after July 1, 2014, the principal in the 9fund from proceeds received by the state associated with the Deepwater Horizon oil spill or 10any other source shall not be subject to appropriation unless authorized by a joint resolution 11approved by two-thirds of the elected members of each house of the legislature; and 12 WHEREAS, R.S. 39:91 requires that, for Fiscal Year 2019-2020, forty-five percent 13of economic damages proceeds from the Deepwater Horizon oil spill be deposited into the 14Medicaid Trust Fund for the Elderly; and 15 WHEREAS, R.S. 46:2742(B)(11) provides that re-basing of nursing home rates shall 16occur, at a minimum, biennially. 17 THEREFORE, BE IT RESOLVED that pursuant to R.S. 46:2691(B), the Legislature 18of Louisiana does hereby consent to make the principal amount of the Medicaid Trust Fund 19for the Elderly available for appropriation for Fiscal Year 2020-2021 for the purpose of re- 20basing nursing home rates.
