SLS 201ES-363 ORIGINAL 2020 First Extraordinary Session SENATE CONCURRENT RESOL UTION NO. 27 BY SENATORS BOUDREAUX, CORTEZ, WHITE, CLOUD, ABRAHAM, BARROW, FESI, HARRIS, HENRY, JOHNS, TARVER AND WOMACK HEALTH DEPARTMENT. Directs the Louisiana Department of Health to seek independent consultant opinions and alternative options for the submission of the Managed Care Section 438.6(c) Preprint to CMS for FY22 prior to finalization. 1 A CONCURRENT RESOL UTION 2 To authorize and direct the Louisiana Department of Health to seek independent consultant 3 opinions and alternative options for the submission of the Managed Care Section 4 438.6(c) Preprint to the Centers for Medicare and Medicaid Services for Fiscal Year 5 2022 prior to finalization. 6 WHEREAS, to address concerns regarding state-directed payments used in state 7 Medicaid programs, the Centers for Medicare and Medicaid Services (CMS) promulgated 8 42 CFR 438.6(c) to provide for permissible alternative approaches for payment delivery 9 systems and provider payment initiatives; and 10 WHEREAS, Section 438.6(c) provides states with the flexibility to implement 11 delivery systems and provider payment initiatives under Medicaid managed care contracts; 12 and 13 WHEREAS, the Louisiana Department of Health is required to submit the Managed 14 Care Section 438.6(c) Preprint for approval by CMS each fiscal year; and 15 WHEREAS, Medicaid remains the largest single item in Louisiana's operating 16 budget; and 17 WHEREAS, to be a good steward and manage the resources available to the 18 Louisiana Medicaid program prudently and responsibly, the department should obtain input Page 1 of 2 SCR NO. 27 SLS 201ES-363 ORIGINAL 1 from all qualified persons who can provide a constructive analysis of and recommend 2 beneficial changes to the Medicaid payment delivery systems and provider payment 3 initiatives. 4 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 5 authorize and direct the Louisiana Department of Health to seek independent consultant 6 opinions and alternative options for the submission of the Managed Care Section 438.6(c) 7 Preprint to the Centers for Medicare and Medicaid Services for Fiscal Year 2022 prior to 8 finalization. 9 BE IT FURTHER RESOLVED that the department shall submit a report containing 10 the alternative options developed by the department pursuant to this Resolution to the Joint 11 Legislative Committee on the Budget on or before February 1, 2021. 12 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 13 secretary of the Louisiana Department of Health.
