[R.S. 1:13(B) and 24:177(E)] HB 32 Engrossed 2020 Second Extraordinary Session Zeringue Abstract: Requires that during a declared state of emergency or public health emergency, restaurants and establishments selling alcoholic beverages for consumption on the premises be subject to uniform restrictions, if any. Present law authorizes the governor or a parish president to declare a state of emergency pursuant to the La. Homeland Security and Emergency Assistance and Disaster Act. Present law authorizes the governor to declare a state of public health emergency pursuant to the La. Health Emergency Powers Act. Proposed law provides that during a state of emergency as declared by the governor or the parish president or during a public health emergency restaurants and establishments selling alcoholic beverages for consumption on the premises shall be subject to uniform restrictions, if any, including restrictions on occupancy and operation. Effective upon signature of governor or lapse of time for gubernatorial action.
