HOUSE BILL NO. 32
BY REPRESENTATIVES ZERINGUE AND MAGEE
GOVERNMENTAL REGULATIONS:  Provides for the operation of restaurants and bars
during a declared emergency or disaster (Items #32, 35, and 60)
1	AN ACT
2To enact R.S. 29:732.1 and 776, relative to the operation of restaurants and establishments
3 selling alcoholic beverages during a state of emergency or public health emergency;
4 to require that restaurants and establishments selling alcoholic beverages be subject
5 to uniform restrictions; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 29:732.1 and 776 are hereby enacted to read as follows: 
8 §732.1.  Operation of restaurants and establishments selling alcoholic beverages
9	During a state of emergency as declared by the governor or the parish
10 president pursuant to this Chapter, restaurants and establishments permitted pursuant
11 to Title 26 of the Louisiana Revised Statutes of 1950 to sell alcoholic beverages on
12 the premises for consumption on the premises shall be subject to uniform
13 restrictions, if any, including restrictions on occupancy and operation.

15 §776.  Operation of restaurants and establishments selling alcoholic beverages
16	R.S. 29:732.1 shall apply to this Chapter. 
17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18signed by the governor, upon expiration of the time for bills to become law without signature
19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If

1vetoed by the governor and subsequently approved by the legislature, this Act shall become
2effective on the day following such approval.

Abstract:  Requires that during a declared state of emergency or public health emergency,
restaurants and establishments selling alcoholic beverages for consumption on the
premises be subject to uniform restrictions, if any.
Present law authorizes the governor or a parish president to declare a state of emergency
pursuant to the La. Homeland Security and Emergency Assistance and Disaster Act.
Present law  authorizes the governor to declare a state of public health emergency pursuant
to the La. Health Emergency Powers Act.
Proposed law provides that during a state of emergency as declared by the governor or the
parish president or during a public health emergency restaurants and establishments selling
alcoholic beverages for consumption on the premises shall be subject to uniform restrictions,
if any, including restrictions on occupancy and operation.
Effective upon signature of governor or lapse of time for gubernatorial action.
