HLS 202ES-317 ENGROSSED 2020 Second Extraordinary Session HOUSE CONCURRENT RESOL UTION NO. 25 BY REPRESENTATIVE GADBERRY TEACHERS: Requests that the State Civil Service Commission establish the same or substantially similar sick leave benefits for classified employees serving as teaching staff within the Dept. of Public Safety and Corrections, office of juvenile justice, as those provided for public school teachers injured or disabled while acting in their official capacity 1 A CONCURRENT RESOL UTION 2To urge and request the State Civil Service Commission to establish the same or 3 substantially similar benefits as those provided in R.S. 17:1201(C)(1) and (D)(1), 4 relative to sick leave benefits for public school teachers injured or disabled while 5 acting in their official capacity, for classified employees serving as teaching staff 6 within the Department of Public Safety and Corrections, office of juvenile justice. 7 WHEREAS, present law (R.S. 17:1201(C)(1) and (D)(1)) provides relative to sick 8leave benefits afforded to a member of the teaching staff of a public school who, while 9acting in his official capacity, is injured or disabled either as the result of assault and battery 10or as the result of physical contact with a student while providing physical assistance to 11prevent danger or risk of injury to the student, including that he shall receive sick leave 12without reduction in pay and without reduction in accrued sick leave days; and 13 WHEREAS, for purposes of present law, teachers are defined as those employed by 14city, parish, or other local public school boards; and 15 WHEREAS, those serving as teaching staff within the Department of Public Safety 16and Corrections, office of juvenile justice, do not fall under this definition and are thus not 17afforded the same sick leave benefits when injured or disabled on the job as their 18counterparts who are employed by local school boards; and Page 1 of 2 HLS 202ES-317 ENGROSSED HCR NO. 25 1 WHEREAS, personnel policies applicable to employees of state agencies are the 2responsibility of the State Civil Service Commission. 3 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 4urge and request the State Civil Service Commission to establish the same or substantially 5similar benefits as those provided in R.S. 17:1201(C)(1) and (D)(1), relative to sick leave 6benefits for public school teachers injured or disabled while acting in their official capacity, 7for classified employees serving as teaching staff within the Department of Public Safety and 8Corrections, office of juvenile justice. 9 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 10director of the Department of State Civil Service.
