SENATE BILL NO. 47

1	AN ACT
2 To amend and reenact R.S. 39:100.43(F), relative to the Coronavirus Local Recovery
3 Allocation Program; to determine the maximum allocation for each parish from the
4 Coronavirus Local Recovery Allocation Fund; to provide for an effective date; and
5 to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 39:100.43(F) is hereby amended and reenacted to read as follows:

11	F. The commissioner of administration shall develop a method to determine
12 the maximum allocation for each parish based on total population of the parish and
13 the number of confirmed cases of COVID-19 within the parish the successful
14 reduction in COVID-19 transmissions in the parish and the proportion of
15 approved reimbursable expenditures for the parish relative to the total
16 approved reimbursable expenditures for all parishes. The commissioner shall
17 notify each applicant that there is no guarantee that the amount of funds received by

1 the local government units of a parish shall equal the maximum amount allocated to
2 the parish. If on November 1, 2020, any parish has an unobligated portion of their
3 allocation, the unobligated portion may be moved by the commissioner of
4 administration to other parishes which have used all of their allocation and have
5 remaining submissions, subject to approval of the Joint Legislative Committee on
6 the Budget.

8 Section. 2. The provisions of this Act shall only apply to any monies in the allocation
9 fund which are unobligated as of the effective date of this Act.
10 Section 3.  This Act shall become effective upon signature by the governor or, if not
11 signed by the governor, upon expiration of the time for bills to become law without signature
12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
13 vetoed by the governor and subsequently approved by the legislature, this Act shall become
14 effective on the day following such approval.

Present law established the Coronavirus Local Recovery Allocation Program and the
Coronavirus Local Recovery Allocation Fund (allocation fund) to allocate federal CARES
Act monies in the allocation fund to local government units in each parish for eligible
expenses as provided in the CARES Act.
Present law authorizes the commissioner of administration to determine the maximum
allocation for each parish based on total population of the parish and the number of
confirmed cases of COVID-19 within the parish. 
Proposed law authorizes the commissioner of administration to determine the maximum
allocation for each parish based on the successful reduction in COVID-19 transmissions in
the parish and the proportion of approved reimbursable expenditures for the parish relative
to the total approved reimbursable expenditures for all parishes.
Proposed law applies only to any monies in the allocation fund which are unobligated as of
the effective date of proposed law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
