SENATE BILL NO. 5

1	AN ACT
2 To amend and reenact R.S. 51:61, 64, and 65, relative to foreign trade zones; to provide
3 relative to the Plaquemines Port, Harbor and Terminal District; to provide
4 authorization for the district to make application to be designated as a foreign trade
5 zone; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 51:61, 64, and 65 are hereby amended and reenacted to read as
8 follows:
9 §61. Definitions
10	Whenever used in this Part, "board" refers to the New Orleans Aviation
11 Board, the Board of Commissioners of the Lake Charles Harbor and Terminal
12 District, the South Louisiana Port Commission, the Livingston-Tangipahoa Parishes
13 South Tangipahoa Parish Port Commission, the Greater Baton Rouge Port
14 Commission, the Caddo-Bossier Port Commission, the Vidalia Port Commission, the
15 Board of Commissioners of the England Economic and Industrial Development
16 District, and the Board of Commissioners of the Port of New Orleans, and the
17 Plaquemines Port, Harbor and Terminal District, and in addition thereto, any port
18 commission or port, harbor, and terminal district, the New Orleans Regional
19 Business Park, and any airport with an industrial park or property designated for
20 industrial development.

22 §64. Buildings or enclosures
23	The board may lease the right to do so or may erect, maintain, and operate

1 any structures, buildings, or enclosures as may be necessary or proper for
2 establishing and operating any foreign trade zones or subzones that may be
3 established in the New Orleans International Airport, the South Louisiana Port
4 Commission, the Lake Charles Harbor and Terminal District, the Livingston-
5 Tangipahoa Parishes South Tangipahoa Parish Port Commission, the Greater
6 Baton Rouge Port Commission, the Caddo-Bossier Port Commission, the Vidalia
7 Port Commission, the England Economic and Industrial Development District, or in
8 the Port of New Orleans, the Plaquemines Port, Harbor and Terminal District,
9 or any port commission or port, harbor, and terminal district, the New Orleans
10 Regional Business Park, and any airport commission with an industrial park or
11 property designated for industrial development under and by virtue of 19 U.S.C.
12 §81a et seq.
13 §65. Extent of authority of commissioners
14	The authority granted in this Part to the board confers on the board the right
15 to do all things necessary and proper to carry into effect the establishing,
16 maintaining, and operating of foreign trade zones in the New Orleans International
17 Airport, the South Louisiana Port Commission, the Lake Charles Harbor and
18 Terminal District, the Port of New Orleans, the Livingston-Tangipahoa Parishes
19 South Tangipahoa Parish Port Commission, the Caddo-Bossier Port Commission,
20 the Vidalia Port Commission, the England Economic and Industrial Development
21 District, or the Greater Baton Rouge Port Commission, the Plaquemines Port,
22 Harbor and Terminal District, or any port commission or port, harbor, and
23 terminal district, the New Orleans Regional Business Park, and any airport with an
24 industrial park or property designated for industrial development, and to comply
25 fully with the provisions of 19 U.S.C. §81a et seq. and all regulations that may be
26 made under it. Further, a board which that does not have federally authorized
27 foreign trade zone status may enter into agreement with another board which that
28 has federally granted foreign trade zone authority to establish, maintain, or operate
29 a subzone or subzones within the jurisdiction of the board, provided that such the
30 agreement shall not limit or affect the powers and authority of either board.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
