[R.S. 1:13(B) and 24:177(E)] HB 12 Reengrossed 2020 Regular Session Carpenter Abstract: Relative to the benefits of members of the Firefighters' Retirement System (FRS) who return to work with an employer covered by the system. Present law provides that if a retiree from FRS returns to work in a full-time position covered by the system, payment of his retirement benefits ceases. Proposed law removes the requirement for cessation of benefits applicable to an FRS retiree who returns to work in a part-time position covered by the system. Present law provides that the employee and employer contribute to the system during full-time reemployment and that the retirement option that was selected at the first retirement cannot be changed. Proposed law retains present law and further requires that the employee and employer contribute to the system during any part-time employment, but exclude part-time retirees from accruing credible service during his reemployment. Effective upon signature of governor or lapse of time for gubernatorial action. (Amends R.S. 11:2256(A)(5)) Summary of Amendments Adopted by House The House Floor Amendments to the engrossed bill: 1. Remove the requirement for cessation of benefits applicable to an FRS retiree who returns to work in a part-time position covered by the system. 2. Require that the employee and employer contribute to the system during any part-time employment, and exclude part-time retirees from accruing credible service during such reemployment.
