HOUSE BILL NO. 12
BY REPRESENTATIVE CARPENTER
1	AN ACT
2 To amend and reenact R.S. 11:2256(A)(5), relative to the Firefighters' Retirement System;
3 to provide with respect to the reemployment of retirees; to provide for suspension of
4 benefits; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article X, Section 29(C) of the Constitution
7	of Louisiana.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 11:2256(A)(5) is hereby amended and reenacted to read as follows:
10 ยง2256.  Benefits; refund of contributions, application, and payment
11	A.

13	(5)(a)  Upon returning to work as a full-time employee for a fire department
14 of an employer covered by this system, retirement benefits shall cease and the
15 employee and employer shall contribute to the system towards creditable service. 
16 The member may not change the option which was selected under the first retirement
17 computation.
18	(b) When a person who is retired from this system returns to work on a
19 part-time basis for a fire department of an employer covered by this system,
20 employee and employer contributions shall be remitted to the system, but the retiree

1 shall not accrue creditable service. Employee contributions shall be refunded,
2 without interest, and the system shall retain the employer contributions.

4 Section 2.  This Act shall become effective upon signature by the governor or, if not
5 signed by the governor, upon expiration of the time for bills to become law without signature
6 by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana.  If
7 vetoed by the governor and subsequently approved by the legislature, this Act shall become
8 effective on the day following such approval.
