DRUGS/CONTROLLED: (Constitutional Amendment) Authorizes local governing
authorities to call an election for the purpose of allowing the sale, possession,
distribution, and use of marijuana

2Proposing to add Article XII, Section 17 of the Constitution of Louisiana, to authorize local
3 governing authorities of the state to call an election for the purpose of authorizing
4 the sale, possession, distribution, and use of marijuana; to provide for submission of
5 the proposed amendment to the electors; and to provide for related matters.
6 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
7elected to each house concurring, that there shall be submitted to the electors of the state of
8Louisiana, for their approval or rejection in the manner provided by law, a proposal to add
9Article XII, Section 17 of the Constitution of Louisiana, to read as follows:
10 §17. Local Governing Authorities; Election on Marijuana
11 Section 17. Notwithstanding Article VI, Sections 4 and 5 of this constitution,
12 a local governing authority may call an election for the purpose of authorizing the
13 sale, possession, distribution, and use of marijuana within the jurisdiction of the
14 governing authority.
15 Section 2. Be it further resolved that this proposed amendment shall be submitted
16to the electors of the state of Louisiana at the statewide election to be held on November 3,
172020.
18 Section 3. Be it further resolved that on the official ballot to be used at the election,
19there shall be printed a proposition, upon which the electors of the state shall be permitted

1to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
2follows:
3 Do you support an amendment to provide that a local governing authority
4 may call an election to authorize the sale, possession, distribution, and use
5 of marijuana within its jurisdiction? (Adds Article XII, Section 17)

Abstract: Authorizes a local governing authority to call an election to authorize the sale,
possession, distribution, and use of marijuana within its jurisdiction.
Present law (R.S. 40:966) provides for the regulation of controlled dangerous substances,
and prohibits the possession, distribution, dispensing, or possession with intent to distribute
or dispense marijuana.
Proposed constitutional amendment authorizes a local governing authority to call an election
for the purpose of authorizing the sale, possession, distribution, and use of marijuana within
the jurisdiction of the governing authority.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 3, 2020.
