HOUSE BILL NO. 494

MTR VEHICLE/COMMERCIAL:  Requires course material and testing on recognition,
prevention, and reporting of human trafficking as a part of the commercial motor
vehicle written knowledge test
1	AN ACT
2To enact R.S. 32:402.2 and R.S. 40:1464, relative to a commercial driver license; to require
3 course materials and testing on the recognition, prevention, and reporting of human
4 trafficking; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 32:402.2 is hereby enacted to read as follows:
7 §402.2. Driver education; commercial driver license; human trafficking
8	A.  The Department of Public Safety and Corrections, public safety services,
9 shall include course materials in its "Commercial Driver's License Manual" on the
10 recognition, prevention, and reporting of human trafficking.
11	B.  The written knowledge test administered to an applicant for a Class "A",
12 "B", or "C" commercial driver's license shall include at least two questions relative
13 to the recognition, prevention, and reporting of human trafficking.
14 Section 2.  R.S. 40:1464 is hereby enacted to read as follows:
15 §1464.  Driver training; commercial driver's license; human trafficking
16	A.  Any trade school, community college, agency, public or private school,
17 or person offering instruction in the operation of commercial motor vehicles as part
18 of a commercial motor vehicle driving course curriculum shall include industry
19 specific training on the recognition, prevention, and reporting of human trafficking.

1	B.  (1)  The Board of Regents shall identify and establish industry specific
2 training materials for use in instruction on the recognition, prevention, and effective
3 reporting of human trafficking by persons as a requirement to obtain a Class "A",
4 "B", or "C" commercial driver's license.  The board may collaborate with
5 organizations that specialize in and offer training materials on the recognition,
6 prevention, and reporting of human trafficking for commercial truckers.  The board
7 shall review and update the training materials to take into account changes and trends
8 in human trafficking.  The board shall provide the training materials to the
9 Department of Public Safety and Corrections for inclusion in its "Commercial
10 Driver's License Manual".
11	(2)  The Department of Public Safety and Corrections, public safety services,
12 shall include the training materials identified and established by the Board of
13 Regents in its "Commercial Driver's License Manual".
14 Section 3.  R.S. 40:1464(B)(1) as enacted by this Act shall become effective on
15August 1, 2020.  The remainder of this Act shall become effective on January 1, 2021.

applicant for a Class "A", "B", or "C" commercial driver's license at least two questions
relative to the recognition, prevention, and reporting of human trafficking.

of a commercial motor vehicle driving course curriculum to include industry specific
