BY REPRESENTATIVES SELDERS AND JAMES
CRIMINAL/PROCEDURE:  Provides relative to the reporting of certain information to the
victim notification system after a firearms purchase denial
1	AN ACT
2To amend and reenact R.S. 14:95.1.3(E)(1), relative to the purchase of firearms; to provide
3 relative to the crime of fraudulent firearm and ammunition purchase; to provide
4 relative to certain duties of licensed firearm dealers when a purchase is denied after
5 a criminal background check; to remove the requirement that denials be reported to
6 the Louisiana Automated Victim Notification System; and to provide for related
7 matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 14:95.1.3(E)(1) is hereby amended and reenacted to read as follows: 
10 ยง95.1.3.  Fraudulent firearm and ammunition purchase; mandatory reporting

12	E.(1)  If a person is reported ineligible to purchase firearms by the National
13 Instant Criminal Background Check System (NICS), the licensed dealer shall report
14 the NICS denial to the sheriff of the parish in which the attempted purchase occurred
15 and to the Louisiana Automated Victim Notification System.

Abstract:  Removes the requirement that a licensed firearm dealer report a firearms
purchase denial, based on the purchaser's ineligibility pursuant to a criminal
background check, to the La. Automated Victim Notification System.
Present law provides for the crime of fraudulent firearm and ammunition purchase.  Pursuant
to the provisions of present law, if a person is reported ineligible to purchase firearms by the
National Instant Criminal Background Check System, the licensed dealer shall report the
denial to the sheriff of the parish in which the attempted purchase occurred and to the La.
Automated Victim Notification System.  
Proposed law removes the requirement that the licensed dealer report the denial to the La.
Automated Victim Notification System.
