HOUSE BILL NO. 586

MOTOR VEHICLES:  Authorizes the use of electronic signatures when transferring
certificates of title in certain situations
1	AN ACT
2To amend and reenact R.S. 32:705(B)(4)(a) and to enact R.S. 32:705(B)(5), relative to
3 delivery of certificates to the purchaser of a vehicle; to authorize electronic
4 signatures when transferring certificates of title under certain circumstances; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 32:705(B)(4)(a) is hereby amended and reenacted and R.S.
832:705(B)(5) is hereby enacted to read as follows:
9 ยง705.  Delivery of certificate to purchaser of vehicle

11	B.  For purposes of this Section, an "endorsement" means one of the
12 following:

14	(4)(a)  The signature of the seller in the presence of an authorized officer, as
15 defined in R.S. 32:702(17)(2), who shall verify the identity of the seller and who
16 shall subscribe his name as a witness thereon, when the seller is transferring
17 ownership to a purchaser who is granting a security interest in the vehicle to the
18 federally insured financial institution that is making a secured loan to the purchaser.

1	(5)  The electronic signature of the insured for the purpose of transferring
2 certificates of title when a vehicle has been declared a total loss and is encumbered
3 by a lien.

Abstract:  Authorizes the use of electronic signatures when transferring certificates of title
once a vehicle has been declared a total loss and is encumbered by a lien.
Present law defines "endorsement" by providing acceptable means of approving the delivery
of a certificate of title.
Proposed law expands the definition of "endorsement" to include electronic signatures of an
insured for the purpose of transferring certificates of title when a vehicle has been declared
a total loss and is encumbered by a lien.
(Amends R.S. 32:705(B)(4)(a); Adds R.S. 32:705(B)(5))
