HLS 20RS-442 ORIGINAL 2020 Regular Session HOUSE BILL NO. 611 BY REPRESENTATIVE MCKNIGHT STUDENTS: Provides relative to the collection and sharing of certain student information 1 AN ACT 2To enact R.S. 17:3914(M), relative to student information; to authorize the Board of 3 Regents, the governing authority of each public secondary school, the state 4 Department of Education, and the Louisiana Workforce Commission to share student 5 information; to provide for the use of information for research; to provide conditions; 6 to provide for penalties; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 17:3914(M) is hereby enacted to read as follows: 9 ยง3914. Student information; privacy; legislative intent; definitions; prohibitions; 10 parental access; penalties 11 * * * 12 M.(1) Notwithstanding any provision of this Section to the contrary, the 13 Board of Regents, the governing authority of each public secondary school, the state 14 Department of Education, and the Louisiana Workforce Commission shall exchange 15 student information for the purposes outlined in this Section. 16 (2) The governing authority of each public secondary school shall collect the 17 following personally identifiable information for each public secondary school 18 graduate who earned an industry-based credential: 19 (a) Full name. 20 (b) Date of birth. HLS 20RS-442 ORIGINAL HB NO. 611 1 (c) Social security number. 2 (d) Industry-based credential earned. 3 (3) Each public postsecondary education institution shall collect the 4 following personally identifiable information for each of its students who earned an 5 industry-based credential at a public secondary school in Louisiana: 6 (a) Full name. 7 (b) Date of birth. 8 (c) Social security number. 9 (d) Industry-based credential earned. 10 (4) The governing authority of each public secondary school shall disclose 11 information collected pursuant to Paragraph (1) of this Subsection and each public 12 postsecondary education institution shall disclose information collected pursuant to 13 Paragraph (2) of this Subsection to the Louisiana Workforce Commission for the 14 express purpose of determining whether public secondary school graduates earning 15 industry-based credentials have entered the workforce in the industry for which they 16 earned the credential or pursued further education related to the industry for which 17 they earned the credential. The commission shall share the data with the Board of 18 Regents and the state Department of Education for the express purpose of analysis 19 and evaluation of performance outcomes of career and technical education. The state 20 department shall use the data to develop policies for improving student achievement 21 in this area. 22 (5) These agencies shall keep such information strictly confidential and shall 23 use the information for no other purpose than that provided in Paragraph (2) of this 24 Subsection. 25 (6) Any exchange of student information pursuant to the provisions of this 26 Subsection shall comply with all applicable state and federal law, including the 27 Family Educational Rights and Privacy Act. Workforce Commission to share student information for research and policy development purposes. Present law provides for the protection of personally identifiable student information. Proposed law provides that notwithstanding present law the Bd. of Regents, governing authority of each public secondary school, the Dept. of Education, and the La. Workforce Commission shall exchange student information, including full name, date of birth, and social security number, for the express purpose of gathering data regarding rates of students obtaining industry credentials and entering into the field for which they earned such credentials or pursuing further education related to the industry for which they earned such credentials. Requires that confidentiality of shared information be maintained and provides for penalties for breaching confidentiality.
