HOUSE BILL NO. 711

ENVIRONMENT/ENFORCEMENT:  Increases certain fees and establishes a new fee for
radioactive disposal processing
1	AN ACT
2To amend and reenact R.S. 30:2351.59(C)(1)(b), (3)(a)(i) and (iii), and (b)(i) and (iii), and
3 to enact R.S. 30:2014(D)(4)(d), relative to fees collected by the Department of
4 Environmental Quality; to authorize a minimum amount for fees paid to the
5 department; to authorize an increase of certain fees paid to the department; to
6 authorize an increase for underground storage tank fees; to authorize an increase in
7 fees deposited into the Lead Hazard Reduction Fund; and to provide for related
8 matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 30:2351.59(C)(1)(b), (3)(a)(i) and (iii), and (b)(i) and (iii) are hereby
11amended and reenacted and R.S. 30:2014(D)(4)(d) is hereby enacted to read as follows:

1	(d)  Except for the Underground Storage Tank registration fee and
2 notwithstanding any other provision of law, the department may establish a
3 minimum fee of two hundred and fifty dollars for any permit, license, registration,
4 or variance.  The Underground Storage Tank registration fee shall not be increased.
5 All proceeds from the fees shall be deposited to the Environmental Trust Dedicated
6 Fund Account in an amount equal to the proceeds of all fees authorized by this
7 Subsection and R.S. 30:2351.9(C).  In addition, the department is authorized to
8 increase fees as follows:
9	(i)  Air fees provided for in Part III of Title 33 of the Louisiana
10 Administrative Code:
11	(aa)  The criteria pollutant annual fee per ton emitted on an annual basis for
12 all facility types may be increased by an amount not to exceed twenty dollars per ton.
13	(bb)  The agent accreditation for asbestos fees may be increased by an
14 amount not to exceed three hundred and fifty dollars.
15	(cc)  The emergency processing fees may be increased by an amount not to
16 exceed one and a half times the regular fees in effect on July 1, 2020.
17	(dd)  In addition, the secretary is hereby authorized to establish an application
18 fee of five thousand dollars for the issuance of asbestos disposal verification forms
19 for a single site for the period of one fiscal year.
20	(ii)  Solid waste fees provided for in Part VII of Title 33 of the Louisiana
21 Administrative Code:
22	(aa)  Establish a waste tire transporter authorization application fee not to
23 exceed two hundred and fifty dollars, which shall be deposited into the Waste Tire
24 Management Fund.
25	(bb)  In addition, the secretary is hereby authorized to establish an annual fee
26 schedule for all transporters of solid waste with a facility located in Louisiana.
27	(iii)  Radiation protection fees provided for in Part XV of Title 33 of the
28 Louisiana Administrative Code:

1	(aa)  The secretary may establish that the naturally occurring radioactive
2 materials general license fees shall be billed on the wellhead regardless of the field.
3 No maximum fee shall apply.
4	(bb)  In addition, the secretary is hereby authorized to establish a fee schedule
5 for the following activities:
6	(i)  A commercial naturally occurring radioactive materials waste disposal
7 application fee in the amount of twenty three thousand dollars.
8	(ii)  A commercial naturally occurring radioactive materials waste disposal
9 annual fee in the amount of twenty thousand dollars.

15	(b)  Certification fees shall be paid for the following disciplines:
16	(i)  Lead project supervisor $ 275.00 $350.00
17	(ii)  Lead project designer	$ 550.00
18	(iii)  Risk assessor	$ 275.00 $350.00
19	(iv)  Lead inspector	$ 165.00 $250.00
20	(v)  Lead worker	$   55.00 $250.00

22	(3)  Notification fees will be due upon application as follows:
23	(a)  For the lead abatement of a building or other structure, the fee shall be
24 based upon the projected lead-based painted areas to be abated in the abatement
25 project.  Areas of lead-contaminated soil associated with the abatement process will
26 be included in the projected square footage for the building or structure as follows:
27	(i)2000 square feet and under $ 220.00 $250.00

Abstract:  Establishes a new fee for radioactive waste disposal processing and provides for
an increase in certain fees by the Dept of Environmental Quality (DEQ).
Present law allows DEQ to charge certain fees. Proposed law retains present law.
Proposed law authorizes a minimum fee of $250 for any permit, license, registration, or
variance except for the Underground Storage Tank registration fee which will not be
increased.
Proposed law authorizes increases in air fees as follows:
(1) Criteria pollutant annul all feenot to exceed $20 per ton
(2) Agent accreditation fee for asbestos feenot to exceed $350 
(3) Emergency processing fees not to exceed one and one-half times the fee
in effect on 7/1/20
(4) New fee for asbestos disposal certification forms$5000 for one fiscal year
Proposed law authorizes increases in solid waste fees as follows:
(1) Waste tire transporter authorization application feenot to exceed $250
(2) Authorize an annual fee schedule for all transporters of solid waste with a facility in La.
Proposed law relative to radioactive waste disposal processing authorizes fees to be billed
at the wellhead regardless of the field.  Further authorizes fees for a commercial naturally
occurring radioactive materials waste disposal application fee of $23,000 and a commercial
naturally occurring radioactive materials waste disposal annual fee of $20,000.
Proposed law increases fees paid into the Lead Hazard Reduction Fund as indicated:
