[R.S. 1:13(B) and 24:177(E)] HB 770 Original 2020 Regular Session Bryant Abstract: Amends the definition of "marijuana" to exclude candies or any edible compound or substance and any liquid substance regulated pursuant to proposed law (Chapter 9 of Title 26 of the La. Revised Statutes of 1950). Present law provides for a definition of "marijuana" which means all parts of plants of the genus Cannabis, whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. Present law further provides that the term "marijuana" does not include the following: (1)Industrial hemp that is in the possession, custody, or control of a person who holds a license issued by the La. Dept. of Agriculture and Forestry, or is cultivated and processed in accordance with the U.S. Agriculture Improvement Act of 2018. (2)The mature stalks of plants of the genus Cannabis, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seeds of such plant which is incapable of germination. (3)Cannabidiol when contained in a drug product approved by the U.S. Food and Drug Administration. Proposed law adds candy or candies or any edible compound or substance and any liquid substance that can be ingested or applied topically and regulated pursuant to proposed law (HB ___ of the 2020 R.S., Chapter 9 of Title 26 of the La. Revised Statutes of 1950) as exceptions to the present law definition of marijuana. Proposed law is contingent upon the passage of proposed law (HB ___ of the 2020 R.S.)
