HOUSE BILL NO. 774

PROCUREMENT:  Provides with respect to post-emergency procurement
1	AN ACT
2To enact R.S. 39:1604.8, relative to public procurement; to require purchases from
3 Louisiana vendors in certain circumstances; to provide time limits; to provide
4 exceptions; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 39:1604.8 is hereby enacted to read as follows: 
7 ยง1604.8.  Preference for Louisiana vendors after an emergency
8	A.  Notwithstanding any provision of law to the contrary, in order to stabilize
9 the Louisiana economy and rebuild financial security for its citizens after the
10 devastating impact of the COVID-19 virus, any new procurement entered into
11 pursuant to the provisions of this Chapter in the eight-month period immediately
12 following recision of any gubernatorial proclamation or order suspending application
13 of the Louisiana Procurement Code in response to the COVID-19 virus shall be
14 contracted with a Louisiana vendor to the extent possible.   Upon written certification
15 by the chief procurement officer that a Louisiana vendor is unable to supply the
16 quality or quantity of goods or services needed, the provisions of this Section shall
17 not apply.
18	B.  The provisions of this Section shall not apply to any contract financed in
19 whole or in part by contributions or loans from any agency of the United States
20 government.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract: Provides a preference for Louisiana vendors in certain limited circumstances.
Present law establishes requirements and regulations for state contracting.
Proposed law provides that, due to the exigent circumstances surrounding the COVID-19
virus pandemic, in the eight-month period immediately following recision of the governor's
proclamation suspending the La. Procurement Code during the pandemic, any new
procurement entered into in that time period shall be contracted with a Louisiana vendor to
the extent possible.  Provides an exception when the quantity or quality of goods or services
needed is unavailable from a Louisiana vendor.  Also excepts contracts financed in whole
or in part from contributions or loans from the U.S. government.
Effective upon signature of governor or lapse of time for gubernatorial action.
