HOUSE BILL NO. 788

NATURAL RESOURCES DEPT:  Provides relative to authorizations for coastal protection
annual and master plans
1	AN ACT
2To amend and reenact R.S. 49:214.5.3(E)(1), (3), and (4), relative to coastal protection
3 annual plans; to provide authorizations for coastal protection annual and master
4 plans; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 49:214.5.3(E)(1), (3), and (4) are hereby amended and reenacted to
7read as follows:
8 ยง214.5.3.  Coastal protection annual plans; development; priorities

10	E.(1)  After adoption by the board, the  master plan shall be submitted to the
11 House Committee on Natural Resources and Environment and the Senate Committee
12 on Natural Resources and the House Committee on Transportation, Highways, and
13 Public Works and the Senate Committee on Transportation, Highways, and Public
14 Works for approval.  In addition, the annual plan shall be submitted to the House
15 Committee on Natural Resources and Environment and the Senate Committee on
16 Natural Resources and the House Committee on Transportation, Highways, and
17 Public Works and the Senate Committee on Transportation, Highways, and Public
18 Works on or before the fifteenth day of the regular legislative session of each year.

1 to the applicable legislative committees for review in a separate plan, and shall be
2 done in a separate resolution following the same procedures for approval as outlined
3 in this Subsection.  The committees shall take action on the annual plan on or before
4 June first of each calendar year.

6	(3)  The legislature may approve or disapprove a plan by resolution adopted
7 by a majority vote of the members of each house of the legislature.  If the legislature
8 disapproves a plan, it shall include in the resolution a brief summary of the reasons
9 for disapproval and may make recommendations concerning any changes it deems
10 necessary or appropriate to remedy any deficiencies in the plan.  No expenditures on
11 a plan shall be authorized until such time as the legislature approves a plan by
12 resolution adopted by a majority vote of each house of the legislature.
13	(4)  If the legislature approves the master plan, or if the legislature fails to
14 take action on the master plan within sixty days after the plan is submitted, the board
15 shall provide for implementation of the plan as submitted. approved.  If the
16 legislature approves the annual plan, or if the legislature fails to disapprove the
17 annual plan by July first, the board shall provide for implementation of the plan as
18 submitted. approved.  The projects and programs provided for in the annual plan
19 shall be undertaken in conformity with the order of priority as contained in the
20 annual plan.

Abstract:  Provides for the process by which the Legislature of Louisiana adopts coastal
restoration projects designed to divert Mississippi River water into either the
Barataria or Breton basins.
Present law provides that after adoption by the board,  the Coastal Protection and Restoration
Authority (CPRA) must submit its annual plan to the House Committee on Natural
Resources and Environment and the Senate Committee on Natural Resources and the House

Committee on Transportation, Highways and Public Works and the Senate Committee on
Transportation, Highways and Public Works for approval.  Proposed law retains present law.
Proposed law further requires that any coastal restoration project which is designed to divert
Mississippi River water into either the Barataria or Breton basins be presented to the
applicable legislative committees for review in a separate plan and must be done in a

present law and further adds that no expenditures on a plan can be authorized until such time
as the legislature approves a plan by resolution adopted by a majority vote of each house of
the legislature.
Present law further provides that if the legislature fails to take action on the master plan
within 60 days after the plan is submitted, the board shall provide for implementation of the
plan as submitted.
Proposed law modifies present law by specifying that if the legislature approves the master
plan it must provide for implementation of the plan as approved.
