HOUSE BILL NO. 854

AGRICULTURAL COMMODITIES:  Provides an exception to prohibited CBD products
and creates civil penalties
1	AN ACT
2To amend and reenact R.S. 3:1482(A)(1) and to enact R.S. 3:1485, relative to industrial
3 hemp derived cannabidiol products; to provide for exceptions to prohibition on sell
4 of certain cannabidiol  products; to create civil penalties; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 3:1482(A)(1) is hereby amended and reenacted and R.S. 3:1485 is
8hereby enacted to read as follows:
9 §1482.  CBD products; prohibitions; Louisiana Department of Health
10	A.  No person shall process or sell:
11	(1)  Any part of hemp for inhalation, except for hemp rolling papers.

13 §1485.  Civil penalties
14	At the discretion of the commissioner and in lieu of the criminal penalties
15 provided for in R.S. 3:1484, any licensee permitted under R.S. 3:1483 who violates
16 any of the provisions of this Part may be subject to having his permit suspended or
17 revoked, in addition to any other penalties authorized by this Part or by law.

Abstract:  Adds hemp rolling papers as an exception on the prohibition to sell any part of
hemp for inhalation and establishes civil penalties.
Present law prohibits the sale of any part of industrial hemp for inhalation.
Proposed law retains present law and adds an exception for the sale of hemp rolling papers.
Present law provides for criminal penalties applicable to any person who violates provisions
related to the processing and sale of cannabidiol (CBD) products.
Proposed law retains present law and establishes civil penalties of suspension or revocation
of a permit to sell CBD products to be enforced in lieu of criminal penalties at the discretion
of the commissioner of alcohol and tobacco control.
