HOUSE BILL NO. 88

ELECTION CODE:  Prohibits disclosure by registrars of voters, clerks of court, and the
Department of State of information related to voter registration and election
management computer systems
1	AN ACT
2To amend and reenact R.S. 18:154(G)(4) and to enact R.S. 18:154(G)(6), relative to voter
3 registration records and related computer systems; to prohibit disclosure of certain
4 computer system information by the registrar of voters, the clerk of court, and the
5 Department of State; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 18:154(G)(4) is hereby amended and reenacted and R.S.
818:154(G)(6) is hereby enacted to read as follows:
9 ยง154.  Records open to inspection; copying; exceptions

11	G.  Notwithstanding any provision of this Section to the contrary, the
12 registrar, the clerk of court, and the Department of State shall be prohibited from
13 disclosing the following:

15	(4)  Computer system or program information, including software, related
16 menus, flow charts, network diagrams, usernames, nonpublic uniform resource
17 locators, database object names, computer names, device identifiers and serial
18 numbers, screen printouts and captures, internet protocol address numbers,
19 passwords, source materials, prompts, dialogues, operating and instructional

1 manuals, programming materials or instructions, and any other computer operating
2 or support materials concerning the state voter registration computer system and
3 election management system or voting equipment.

5	(6)  Internet protocol address numbers submitted to or captured by the state
6 voter registration computer system and election management system.

8 Section 2.  This Act shall become effective upon signature by the governor or, if not
9signed by the governor, upon expiration of the time for bills to become law without signature
10by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
11vetoed by the governor and subsequently approved by the legislature, this Act shall become
12effective on the day following such approval.

Abstract:  Specifies additional information relative to the state voter registration computer
system, the election management system, or voting equipment that registrars of
voters, clerks of court, and the Dept. of State are prohibited from disclosing.
Present law provides that the records of each registrar of voters are public records.  Provides
exceptions.
Present law prohibits the registrar of voters, the clerk of court, and the Dept. of State from
disclosing computer system or program information, including software, related menus, flow
charts, network diagrams, passwords, source materials, prompts, dialogues, operating
manuals, programming materials or instructions, and any other computer operating or
support materials concerning the state voter registration computer system and election
management system, or voting equipment.  Proposed law adds usernames, nonpublic
uniform resource locators, database object names, computer names, device identifiers and
serial numbers, screen printouts and captures, internet protocol address numbers, and
instructional manuals to the list of information that is prohibited from being disclosed.
Proposed law also prohibits disclosure of internet protocol address numbers submitted to or
captured by the state voter registration computer system and election management system.
Effective upon signature of governor or lapse of time for gubernatorial action.
