SENATE BILL NO. 154

PORTS/HARBORS/TERMINALS.  Authorizes Plaquemines Port, Harbor and Terminal
District to apply for designation as a foreign trade zone. (8/1/20)
1	AN ACT
2 To amend and reenact R.S. 51:61, 64, and 65, relative to foreign trade zones; to provide
3 relative to the Plaquemines Port, Harbor and Terminal District; to provide
4 authorization for the district to make application to be designated as a foreign trade
5 zone; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 51:61, 64, and 65 are hereby amended and reenacted to read as
8 follows:
9 §61. Definitions
10	Whenever used in this Part, "board" refers to the New Orleans Aviation
11 Board, the Board of Commissioners of the Lake Charles Harbor and Terminal
12 District, the South Louisiana Port Commission, the Livingston-Tangipahoa Parishes
13 Port Commission, the Greater Baton Rouge Port Commission, the Caddo-Bossier
14 Port Commission, the Vidalia Port Commission, the Board of Commissioners of the
15 England Economic and Industrial Development District, and the Board of
16 Commissioners of the Port of New Orleans, and the Plaquemines Port, Harbor
17 and Terminal District, and in addition thereto, any port commission or port, harbor,

1 and terminal district, the New Orleans Regional Business Park, and any airport with
2 an industrial park or property designated for industrial development.

4 §64. Buildings or enclosures
5	The board may lease the right to do so or may erect, maintain, and operate
6 any structures, buildings, or enclosures as may be necessary or proper for
7 establishing and operating any foreign trade zones or subzones that may be
8 established in the New Orleans International Airport, the South Louisiana Port
9 Commission, the Lake Charles Harbor and Terminal District, the Livingston-
10 Tangipahoa Parishes Port Commission, the Greater Baton Rouge Port Commission,
11 the Caddo-Bossier Port Commission, the Vidalia Port Commission, the England
12 Economic and Industrial Development District, or in the Port of New Orleans, the
13 Plaquemines Port, Harbor and Terminal District, or any port commission or port,
14 harbor, and terminal district, the New Orleans Regional Business Park, and any
15 airport commission with an industrial park or property designated for industrial
16 development under and by virtue of 19 U.S.C. §81a et seq.
17 §65. Extent of authority of commissioners
18	The authority granted in this Part to the board confers on the board the right
19 to do all things necessary and proper to carry into effect the establishing,
20 maintaining, and operating of foreign trade zones in the New Orleans International
21 Airport, the South Louisiana Port Commission, the Lake Charles Harbor and
22 Terminal District, the Port of New Orleans, the Livingston-Tangipahoa Parishes Port
23 Commission, the Caddo-Bossier Port Commission, the Vidalia Port Commission, the
24 England Economic and Industrial Development District, or the Greater Baton Rouge
25 Port Commission, the Plaquemines Port, Harbor and Terminal District, or any
26 port commission or port, harbor, and terminal district, the New Orleans Regional
27 Business Park, and any airport with an industrial park or property designated for
28 industrial development, and to comply fully with the provisions of 19 U.S.C. §81a
29 et seq. and all regulations that may be made under it. Further, a board which does not

1 have federally authorized foreign trade zone status may enter into agreement with
2 another board which has federally granted foreign trade zone authority to establish,
3 maintain, or operate a subzone or subzones within the jurisdiction of the board,
4 provided that such agreement shall not limit or affect the powers and authority of
5 either board.

Present law authorizes the following entities to make application to be designated as a
foreign trade zone and to establish, maintain, and operate as a foreign trade zone:
(1)New Orleans Aviation Board.
(2)Board of Commissioners of the Lake Charles Harbor and Terminal District.
(3)South La. Port Commission.
(4)Livingston-Tangipahoa Parishes Port Commission.
(5)Greater Baton Rouge Port Commission.
(6)Caddo-Bossier Port Commission.
(7)Vidalia Port Commission.
(8)Board of Commissioners of the England Economic and Industrial Development
District.
(9)Board of Commissioners of the Port of New Orleans.
(10)Any port commission or port, harbor, and terminal district.
(11)New Orleans Regional Business Park.
(12)Any airport with an industrial park or property designated for industrial
development.
Proposed law retains present law and adds the Plaquemines Port, Harbor and Terminal
District.
Proposed law makes technical corrections.
Effective August 1, 2020.
