SENATE BILL NO. 203

LOCAL AGENCIES.  Provides for an increase in per diem for the commissioners of the
Vermilion Waterworks District No. 1.  (gov sig)
1	AN ACT
2 To enact R.S. 33:3819(M), relative to the board of commissioners of Waterworks District
3 No. 1 of Vermilion Parish; to permit an increase in per diem for the commissioners
4 of the board for attending meetings; and to provide for related matters.
5	Notice of intention to introduce this Act has been published.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 33:3819(M) is hereby enacted to read as follows:
8 ยง3819. Meetings of commissioners; meeting place; absences; compensation
9	A. The commissioners of each waterworks district may meet as often as
10 necessary, but shall meet at least once every three months. The board of waterworks
11 commissioners by resolution shall designate a regular meeting place for the holding
12 of its meetings, which shall be held at a place located within the waterworks district
13 or at the parish seat of the parish in which the district is located, even though the
14 parish seat is not within the boundaries of the waterworks district. The absence of a
15 commissioner from any four consecutive meetings shall be deemed to create a
16 vacancy and it shall be filled by the police jury, if the commissioner had been
17 appointed by the police jury, or by appointment of the governing authority of a

1 municipality included in the district, if the commissioner had been appointed by the
2 said governing authority. The parish governing authority in the parish in which each
3 waterworks district is located may fix the per diem to be paid to each of the members
4 of the board of commissioners of the respective waterworks districts in an amount
5 not to exceed sixty dollars for each meeting they attend, up to and including twenty-
6 four meetings in each year and for each special meeting not to exceed twelve special
7 meetings in each year. Per diem provided by this Section shall be paid out of the
8 district funds in the hands of the treasurer; however, no elected official serving as a
9 member of the board of commissioners shall receive any per diem for attending
10 meetings of the board.

12	M. Notwithstanding the provisions of Subsection A of this Section, the
13 governing authority of the parish of Vermilion may authorize the treasurer of
14 Waterworks District No. 1 of Vermilion Parish to pay the commissioners of the
15 district a per diem not to exceed one hundred-fifty dollars for attendance at
16 board meetings.
17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18 signed by the governor, upon expiration of the time for bills to become law without signature
19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
20 vetoed by the governor and subsequently approved by the legislature, this Act shall become
21 effective on the day following such approval.

Present law provides that a parish governing authority in the parish in which each
waterworks district is located may fix the per diem to be paid to each of the members of the
board of commissioners of the respective waterworks districts in an amount not to exceed
$60 for each meeting they attend, up to and including 24 meetings in each year and for each
special meeting not to exceed 12 special meetings in each year.
Proposed law provides for the board of commissioners of Waterworks District No. 1 of
Vermilion Parish to permit an increase in per diem, not to exceed $150, for the
commissioners of the board for attending board meetings.
