SENATE BILL NO. 258

LAW ENFORCEMENT.  Provides relative to minimum requirements for annual vacation
and sick leave for the employees of the city of Westwego Police Department.

1	AN ACT
2 To amend and reenact R.S. 33:2211(A)(2), R.S. 33:2214(A)(1), and (B)(1) relative to the
3 city of Westwego Police Department; to provide for laws governing employment of
4 municipal police, including matters of compensation, leave, and hours; and to
5 provide for related matters.
6	Notice of intention to introduce this Act has been published.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 33:2211(A)(2), R.S. 33:2214(A)(1) and (B)(1) are hereby amended
9 and reenacted to read as follows:
10 §2211. Applicability; definition of "employee of police department"

12	(2)(a) R.S. 33:2214 shall not apply to the city of Westwego.
13	(b) The provisions of this Subpart, including R.S. 33:2212.1, shall not apply
14 to the city of Mandeville.

16 §2214. Annual vacation; sick leave; recovery from third persons
17	A.(1) Each employee of the police departments of the municipalities

1 embraced by this Subpart, except the city of Westwego, shall, after having served
2 one year with a respective department, be entitled and given with full pay an annual
3 vacation leave of fifteen days during each calendar year, which shall not be denied
4 to any such employee for any reason whatsoever.

6	B.(1) Each employee of the police departments of the municipalities covered
7 by this Subpart, except the city of Westwego, shall be entitled to and given with full
8 pay a sick leave aggregating not less than fifty-two weeks during any calendar year
9 when the conditions actually warrant. Any police department employee who draws
10 such full pay during sick leave shall have such pay decreased by the amount of
11 workers' compensation benefits actually received by such employee.

13 Section 2.  This Act shall become effective upon signature by the governor or, if not
14 signed by the governor, upon expiration of the time for bills to become law without signature
15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16 vetoed by the governor and subsequently approved by the legislature, this Act shall become
17 effective on the day following such approval.

Present law provides for the governing body of each municipality having a population of not
less than 7,000 and not more than 12,000 except for the cities of Westwego and Mandeville:
(1)To pay each employee of its police department a salary of not less than the minimum
rate of pay established in accordance with the grades, ranks, or classes of positions
as provided by law.
(2)To set maximum weekly work hours and providing relative to compensation and
compensatory time required for overtime worked.
(3)To provide for annual leave and sick leave to which officers are entitled.
(4)To provide for holidays and compensation for work on holidays.
Proposed law retains present law but removes the city of Westwego from the exception of
present law.

Present law provides for each employee of the police departments of the municipalities
embraced by current law, with the exception of the city of Westwego, shall, after having
served one year with a respective department, be entitled and given with full pay an annual
vacation leave of 15 days during each calendar year, which shall not be denied to any such
employee for any reason whatsoever.
Proposed law retains present law but removes the city of Westwego from the exception of
present law.
Present law provides for each employee of the police departments of the municipalities
covered by current law, except the city of Westwego, shall be entitled to and given with full
pay a sick leave aggregating not less than 52 weeks during any calendar year when the
conditions actually warrant. Any police department employee who draws such full pay
during sick leave shall have such pay decreased by the amount of workers' compensation
benefits actually received by such employee.
Proposed law retains present law but removes the city of Westwego from the exception of
present law.
Effective upon signature of the governor or lapse of time for gubernatorial action.
