SENATE BILL NO. 269
BY SENATOR FIELDS AND REPRESENTATIVE HUGHES 
SCHOOLS.  Provides relative to elective participation by school boards in the La. Optical
Network Infrastructure (LONI) and for LONI's inclusion in the statewide educational
technology plan. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 17:3921.2(B)(5) and (E), relative to education technology; to
3 require the state Department of Education to include Internet bandwidth assets
4 available through the Louisiana Optical Network Infrastructure in the statewide
5 educational technology plan; to require the Board of Regents to authorize elective
6 participation by school boards in such infrastructure; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 17:3921.2(B)(5) and (E) are hereby amended and reenacted o read
10 as follows:

13	B. The plan shall do all of the following:

15	(5) Identify and utilize all available Internet bandwidth assets, including
16 those provided through the Board of Regent's Louisiana Optical Network
17 Infrastructure and those provided through a request for proposal proposals process

1 through which both public and private entities shall be considered.

3	E. The Board of Regents shall collaborate and cooperate with the state
4 Department of Education to develop policies and procedures to allow public
5 elementary and secondary schools access to all available Internet bandwidth assets
6 provided through a request for proposal proposals process through which both
7 public and private entities shall be considered. Such policies and procedures shall
8 also authorize and provide for elective participation of city, parish, and other
9 local public school boards in the Louisiana Optical Network Infrastructure.

11 Section 2.  This Act shall become effective upon signature by the governor or, if not
12 signed by the governor, upon expiration of the time for bills to become law without signature
13 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
14 vetoed by the governor and subsequently approved by the legislature, this Act shall become
15 effective on the day following such approval.

Present law requires the state Dept. of Education (DOE) to develop a statewide educational
technology plan for public schools. Requires the plan to identify and utilize all available
Internet bandwidth assets provided through a request for proposals process and requires the
Bd. of Regents to collaborate and cooperate with DOE to develop policies and procedures
for schools to access such assets through such a process. 
Proposed law retains present law and additionally requires the plan to identify and utilize all
such assets provided through the Bd. of Regents' La. Optical Network Infrastructure (LONI). 
Proposed law requires that Board of Regents' policies and procedures authorize and provide
for elective participation in LONI by public school boards.
Effective upon signature of the governor or lapse of time for gubernatorial action.
