SENATE BILL NO. 294

STUDENTS.  Requires the state Department of Education to implement a program to
increase the number of meals provided to students. (gov sig)
1	AN ACT
2 To enact R.S. 17:194.1, relative to school nutrition programs; to provide relative to student
3 meals; to provide relative to the reservice of food; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 17:194.1 is hereby enacted to read as follows:
6 ยง194.1. School nutrition program; meals; food reservice
7	A. Not later than January 1, 2021, the state Department of Education,
8 in collaboration with the Louisiana Department of Health, shall develop and
9 implement a program to reduce food loss from school nutrition programs and
10 increase the number of meals provided to students during school, after school,
11 and away from school.
12	B. The Louisiana Department of Health shall adopt rules and regulations
13 necessary to allow the reservice of foods served through any school nutrition
14 program, including food sharing tables and food donation programs, as
15 provided for in the Environmental Protection Agency's Food Recovery
16 Challenge and United States Department of Agriculture regulations.
17	C. The state Department of Education shall submit a written report on

1 the implementation and effectiveness of the program to the Senate Committee
2 on Education and the House Committee on Education by December 1, 2021.
3 Section 2.  This Act shall become effective upon signature by the governor or, if not
4 signed by the governor, upon expiration of the time for bills to become law without signature
5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
6 vetoed by the governor and subsequently approved by the legislature, this Act shall become
7 effective on the day following such approval.

Present law generally provides for school nutrition programs. 
Proposed law requires the state Department of Education (DOE), in collaboration with the
Louisiana Department of Health (LDH) to implement a program to reduce food loss from
school nutrition programs and increase the number of meals provided to students during
school, after school, and away from school. Requires implementation of the program by
1/1/21.
Proposed law requires LDH to adopt necessary rules and regulations to allow for the
reservice of foods and provide for sharing tables and donation programs as provided for in
the Environmental Protection Agency's Food Recovery Challenge and United States
Department of Agriculture regulations.
Proposed law requires DOE to submit a written report on the implementation and
effectiveness of the program to the Senate Committee on Education and the House
Committee on Education by December 1, 2021. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
