SENATE BILL NO. 296

PHARMACISTS.  Provides relative to immunizations administered by pharmacists. (8/1/20)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 37:1218, R.S. 37:1218(5), and
3 1218.1(A), relative to the administration of immunizations by pharmacists; to
4 provide for pharmacist training; to provide for authority to administer vaccinations
5 regardless of age of the patient and without an individual prescription; and to provide
6 for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  The introductory paragraph of R.S. 37:1218, R.S. 37:1218(5), and
9 1218.1(A) are hereby amended and reenacted to read as follows:
10 §1218.  Administration of influenza immunization
11	A pharmacist may administer an influenza immunization to any person seven
12 years of age or older without a prescription or medical order contingent upon all of
13 the following provisions:

15	(5) The pharmacist shall obtain complete the appropriate credential to
16 training to administer influenza immunizations from the board, as administratively
17 defined by the board, prior to administering any such immunization.

1 Documentation verifying completion of the administratively required training
2 shall be made available to the board upon request.
3 §1218.1. Administration of immunizations and vaccines other than influenza
4	immunizations
5	A pharmacist may administer to an individual age seventeen or older an
6 immunization or a vaccine without a patient-specific prescription or medical order
7 if the immunization or the vaccine is administered in conformance with the most
8 current immunization administration protocol as set forth by the United States
9 Centers for Disease Control and Prevention Advisory Committee on Immunization
10 Practice or consistent with United States Food and Drug Administration
11 approved labeling. At the time that a pharmacist administers an immunization or
12 vaccine under the provisions of this Section, the pharmacist shall also inform the
13 individual that the administration of an immunization or vaccine under this Section
14 is not to be construed as being in lieu of an annual checkup with the individual's
15 primary care or family physician.
16	(1) The pharmacist shall report each immunization to the Louisiana
17 Department of Health, office of public health's Louisiana Immunization Network for
18 Kids Statewide at the time of the immunization or as soon as reasonably practicable
19 thereafter, as this is the official state vaccination record.
20	(2) The pharmacist shall report all adverse events he observes or which are
21 reported to him to the Vaccine Adverse Events Reporting System, the cooperative
22 program of the United States Centers for Disease Control and Prevention and the
23 United States Food and Drug Administration for vaccine safety, or its successor
24 program; and further, the pharmacist shall refer the patient with an adverse event to
25 an immunization for appropriate medical care.
26	(3) The pharmacist shall maintain for at least two years a record of each
27 immunization administered.
28	(4) The pharmacist shall obtain complete the appropriate credentials training
29 to administer immunizations from the board, as administratively defined by the

1 board, prior to administering any such immunization. Documentation verifying
2 completion of the administratively required training shall be made available to
3 the board upon request.
4	(5) The pharmacist shall request the name of a patient's primary care provider
5 prior to the administering of any immunization. If the patient identifies such primary
6 care provider to the pharmacist, the pharmacist shall notify the primary care
7 provider, by written or electronic communication, as soon as reasonably possible
8 thereafter that the immunization was administered.

Present law authorizes a pharmacist to administer an influenza immunization to any person
seven years of age or older without a prescription or medical order. Proposed law removes
the age restriction in present law.
Present law requires a pharmacist to obtain appropriate credentialing from the Louisiana
State Board of Pharmacy to administer influenza immunizations. Proposed law requires a
pharmacist to complete training to administer influenza immunizations, as administratively
defined by the board, prior to administering any such immunization. Proposed law requires
a pharmacist to submit documentation verifying completion of the administratively required
training upon request of the board.
Present law provides that a pharmacist shall administer the immunization in conformance
with the most current protocol as set forth by the CDC. Proposed law retains present law and
adds that the protocol may also be consistent with FDA approved labeling.
Proposed law repeals the requirement that a pharmacist inform the individual that the
administration of an immunization or vaccine by the pharmacist is not to be construed as
being in lieu of an annual checkup with the individual's primary care or family physician.
Effective August 1, 2020.
